Has anyone gone through the appeal process?
« on: August 31, 2014, 03:59:22 PM »
I was refused entry due to financial reasons on our civil partner visa application.  Has anyone been through the appeal process? What were your results? Did you hire a lawyer or find an advocate to file for you?  How was that process?
Thanks for any advice!

What was the exact reason given for the visa refusal?

An appeal is only going to be approved if you met all the requirements and you provided all the documents, but UKVI overlooked something and made a mistake in refusing the visa.

If you were correctly refused due to not meeting the financial requirement or not providing the correct documents, then there is no point in appealing the decision, because it will not be successful. Plus, an appeal generally takes up to a year to be processed, so if it's not going to be successful anyway, then it's a waste of time and money to do it.

- If you do actually meet the financial requirement, but you didn't include all the correct documents, then you can just re-apply for the visa, this time making sure you have everything that shows you meet the requirement.

- If you don't meet the financial requirement, then there's nothing you can do except wait until you do meet it and then re-apply.

- Or if the visa was genuinely refused by mistake and you did in fact include everything and meet all the requirements, then you can file an appeal, but be aware that it's likely to take several months to be processed.

Each applicant's situation is different. Just because one person appealed and was successful doesn't mean you will be and vice versa. It depends on the reasons for the refusal.
