It was not "top up fees". It was a vote on education reforms which proposed the ending of free university education for the English and the Welsh. Without Labour making their Scottish MPs stay that Friday to vote, instead of travelling home early as they always did, there would be no university fees in England and Wales because the vote wouldn't have made it thorugh without Labour using their Scottish MPs votes.

The vote on 27 January 2004, was on top up fees. Everyone knows that.

I think it's the Expat Forum.

http://www.expatforum.com/expats/britain-expat-forum-expats-living-uk/623633-please-help-save-our-family.html
The thread over there has now been closed.  The OP's last message was deleted as rude.  It sounds like he wore out his welcome there.  I'd still like to hear the outcome of this case, and how the conclusion was arrived at.  I hope we can somehow get an update.

Also, the donations seem to have stalled at £153.50.

One question I have is why is his staying going to make a difference in her keeping her children? What was she doing before he came along. Apparently if dad's were not in the picture she had the children all along.

Also if he sold everything when he came over, he had no intention of coming back and was fully aware of and/or intending to be an overstayer. I think they knew more than they are admitting and just want an easy way out.

Anyone who is looking to be in a relationship with a person of another country always will do research to see what is necessary to go live in the others country. No one paid for our visa application or airfare.....I am not paying for his.  You have two people who are refusing to work because one cant and the other wont (undiagnosed disorder). My sympathy is not that great because I think they knew exactly what was happening and disregarded it. In the least he knew what he was doing and she put her full trust in him which is leading her down the wrong path.

They are now at £220.00 in donations, and the goal remains at £1601.  The page has the following update:  UPDATE: Our MP couldn't do anything for us.

Surprise Surprise eh? NOT...  ::) ::)

My thoughts exactly :P. An MP can't suddenly get them a visa they don't qualify for, or an appeal that they have no right to :P.

They needed the money by 5th Jan, didn't they? That's tomorrow... I wonder what they're going to do now.

I wonder if they believe what people kept telling them yet.
On s'envolera du même quai
Les yeux dans les mêmes reflets,
Pour cette vie et celle d'après
Tu seras mon unique projet.

Je t'aimais, je t'aime, et je t'aimerai.

My guess is he'll stay, until they catch up with him.

If you check out the group "Helping Save The Kelly Family.", you'll find that they've applied for a Derivative Residence Card as he cares for the wife.

This is quite interesting regarding Derivative Rights of Residence Policy:

https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/246244/FOI_28727_-_Annex_C_-_EOPN_21-2012_-_Zambrano_-_REDACTED_-_20130919.pdf

Degree of evidence required is going to be heavy for the applicants, as there is a presumption of capacity related to adults. Presumption of capacity is also true within health and social care law related to adults.

See the following information regarding the Mental Capacity Act:
http://www.nhs.uk/CarersDirect/moneyandlegal/legal/Pages/MentalCapacityAct.aspx

Yup. Also, I'm not sure how, if by some miracle they do get it, it will affect them later as time spent on it doesn't count towards applying for PR:

You mean doesn't count towards permanent residence, right?  ;)

Just delaying and worsening the problem, IMO. But people do what they are going to do.  ::)

Er sorry, yes that's what I meant, have edited it ;)

I agree completely. But not only are they worsening it for themselves, they are in their own little way making it more difficult for others later on.

From the facebook page I read it that they don't think they are going to get it but  are using the £55 visa as a stall tactic until some kind soul can sell enough make up and knitted chicks for their attorney fee's.
If you are an overstayer and just by applying for random visa's border agents won't come knocking at 6am on morning?

Yeah should have mentioned - I also took it as a stall tactic.
