Self-employment limited company, as the director.
« on: September 22, 2016, 09:22:00 PM »
Hi All,

I am going to be apply for fiancé visa, who is from the USA.

I am self-employment IT Contractor which has limited company, as the director.

Ive been told to apply for fiancé visa as self-employment limited company, you need to provide “ (i) Company Tax Return CT600 (a copy or print out) for the last full financial year and evidence this has been filed with HMRC, such as electronic or written acknowledgment from HMRC

(Page 64 onwards) (i)

https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/525708/Appendix_FM_1_7_Financial_Requirement.pdf

But I’ve been told by a solicitors that meaning of “ last year full financial CT600 and company account” means April to April.

I become a self-employment IT Contractor with my limited company last July 2015, so this year 2016 become 1year for my company, ive done my company accounts. Before July 2015 I was employed permanent.

As the solicitors said since my company hasnt got account from April to April I have to wait until next year (2017) to apply for the fiancé as then I'll have April to April accounts.

Can anyone clarify this??

I have my CT600 and company account which is July 2015 to 2016.

Has anyone applied or aware self-employment director or company owner applied for fiancé visa?

Any help would be much appreciated. :)

Thank you :) :)

You can apply based on July 2015 (when you started) using your accounts up until April 5, 2016.  If you qualify that way (taxable income greater than £18,600), then no need to delay applying.

Hi KFdancer,

Thank you for your reply,

The solicitors said to me my company accounts and CT600 has to be from April 2015 to April 2016.

I since I started my company after it APril 2015, I have to wait until next year so ive got April 2016 to April 2017 account.

I am a director. Ive applied a few times for visas's this way. You need the companies tax year not April to April. Your solicitor is wrong. Make sure you send dividend receipts to cover amount needed.

Have a look at the guidance for the director of a limited company.  It will contradict your solicitor...   ::)

For Director of limited company.

Quote
9.3.2.
For those employed as a director of a specified limited company in the UK, the relevant
financial year(s) will be that covered by the Company Tax Return CT600 and
corresponds to the 12-month accounting year of the company

Emphasis mine.

Like others have said, your solicitor is wrong. You need to use the 12 month period stated on your company's CT600 - in your case July 2015-July 2016.
