Spousal visa refused. Please help :(

My flr spouse visa was refused

"Whilst you have provided all specified evidenced listed in appendix fm-she for your partners salaried employment with . Your partners lowest level of salary held in 6 months was 1250. Which equates 15000"


He is non salaried. He had bonuses and everything. We met it! Also I never got back my passport. Please help me through this I am so upset and can't imagine being split up from my husband.

I'm sorry about your refusal.

I refreshed myself by reading your past posts.  What did you submit for the fiancé visa?  The FLR(M) should simply be an update of that information.  If you met the requirements a few months ago and nothing has changed, then it sounds like you didn't submit quite the same evidence you did for the fiancé visa.

When does your visa expire?

His payslips were

1,275+1,390.38+1,365.38+1,492.31+2,415.38+1,476.92 =9,415.37

Which I then devided by 6 multiply by 12 and got 18830.74

Am I missing something??

What category did you apply under and what category did you apply under previously?

What did his employment letter say?  I know you count on overtime, etc.  Did the letter say that would continue?

I'm not sure what catorgory, I can't remember. I never received my application back

Yes his employer said that he is allowed overtime and bonuses.

His paystub showed overtime multiple months so why would the case worker deny us

You have to show that the overtime WILL continue in the future.  Did the employment letter say that he earns over £18,600?

Knowing the category you applied under is critical.  Can you post the wording of the refusal letter?  Eliminate any names, etc if you'd like.  We can help you get this resolved.

They also have the definition of salaried employment above that statement.

The letter is usually about two pages in length and quotes the rules and says things like 1.3(a)ii. Legal jargon and such.   Do you not have anything like that?

Did your partners employment letter state that he is non-salaried.  Did you apply under a non-salaried category?  Did you demonstrate that overtime will continue in the future?

Something is different with what you submitted now versus a few months ago for the fiancé application.  You know you meet the requirements.  I'm trying to help you figure out what happened differently this time.  I need more info though!

I had a similar problem with mine and I got it worked out. Slightly different circumstances though, was my Fiance/marriage settlement visa we were applying for. KFDancer will help you as best she can.
