Can you get all of the below? If you can, I would seriously consider applying for FLR(M). It would save the risk of immigration and saves waiting until April (for savings) to apply and then waiting for your decision. If you applied for FLR(M) this week you could have your 'spouse' visa (FLR(M)) accepted on the day and your Biometric Residency Card in your hand in the next couple of weeks.

(this checklist taken from a recent post applying for FLR(M) but is roughly what you need providing the financial requirement is met by salaried employment)

APPLICATION
-Applicant Passport, Student Visa, and previous passport.
-Sponsor Passport.
-Applicant photo X2, name on back.
-Sponsor Photo X1, name on back.
-Completed application FLR(m) 12/2016 version.
-Fee payment confirmation print.
-Appointment confirmation print.
-IHS fee payment confirmation email.

FINANCIAL REQUIREMENT
- Last 6 payslips
- Last 6 posted original bank statements.
- Letter from employer stating position, type of employment, start date and current salary (and how long this salary has been held)

ACCOMODATION
-Original tenancy agreement

CORRESPONDENCE LAST 2 YEARS (either shared or an item each) between
-Jan 2015 - April 2015
-May 2015 - Aug 2015
-Sept 2015 - Dec 2015
-Jan 2016 - April 2016
-May 2016 - Aug 2016
-Sept 2016 - Dec 2016

(these are things like bills etc)

RELATIONSHIP
-Original marriage certificate


See if you can achieve it and are considering it and we'll go into exactly what you need  :)

I guess I should say we DID* earn enough, but of course my job changed my contract to end at the end of my visa and my partner has changed her hours in order to accommodate our travels. I really wish we found you earlier, the first information we got from a lawyer seems to have royally *bleep*ed us up.

Definitely only planning to reenter for a couple of weeks and not until April. Going back to the US with my partner and then applying from there in April. I knew I should never risk trying to stay more than a couple of weeks. Also - changing tickets is so difficult these days, and expensive, you basically have to buy a whole new ticket. Sometimes I find it strange that immigration thinks you have thousands of $$ sitting around to buy tickets here and there.

You'll get there in the end. 

Let us know how re-entry goes.  It's likely to be one of those things where if you carry as much documentation as necessary they'll ask for nothing.  Whereas if you have nothing, they'll ask for everything.   ;)

Keep in mind that you likely do not need your lawyer for your spouse visa application. Might be worth thinking of cutting ties with him and re-visiting the forum March/April time as we can help with 99% of applications. This forum got me through our spouse visa application and visa extension.

As KFDancer said, please let us know how your re-entry goes and enjoy your vacation! What will be will be so try and not let it get to your while you enjoy your travels

I plan to have all the documentation imaginable upon reentry lol
