She said Scotland has very different property laws than England, and was going to put me on the lease, but can leave me off and just do in husband's name too. I said to hold off until I asked you all.

In England, landlords are required to check that the person they are renting to has a valid visa for the UK, and they can be fined if they rent to someone who does not have the right to live in the UK (https://www.gov.uk/renting-out-a-property and https://www.gov.uk/check-tenant-right-to-rent-documents)

However, it looks like this does only apply to England, and that landlords in Scotland do not have to carry out the same checks (https://www.gov.uk/renting-out-your-property-scotland/landlord-responsibilities).

So, it would seem that it would be okay for your name to be put on the lease in Scotland.

No news on any fee increases yet. Usually they publish them in February for increases starting on April 6th (though last year the fees increased on March 18th), so we'll just have to see what happens.

Currently a spousal visa costs £1,195 + £600 = £1,795
Priority processing costs £450 on top of this.

So, for a spousal visa with priority processing it costs £2,245.

Is there a reason you are not applying for your Tier 2 dependent visa at the same time?  Best to have your visa in line with your husbands.  Will make everything easier.  Also your visas will be processed in New York, so you'll have a totally different process and likely a MUCH faster processing time.   :)

I thought jessmed3 was applying for a spousal visa?

She's asking about the fees for settlement visas. I assume she means Category B for the visa, not Category 2.

While the onus is not on you to follow the legalities of the tenancy agreement (it's on the landlord), I'd wait until you both have your visas.  Just my 2p.

Oh gosh. Think I used bad grammar and misplaced commas or something. I'm the only one needing a visa.
My husband is UKC and has been in USC for a few years about to go to his native Scotland. I'm waiting to apply for my spouse visa under what I think is Category 2 (uses his new job and old pay stubs to show financial support) -- anyway, waiting because we actually had a holiday booked for this week and last unrelated to the big move. I was waiting until I got to USA to apply as I think I need my passport to get home next week! :)

Running into lease issue myself. My husband and I used his parents for the visa but he ended up finding an apartment we love. Lease would start 3 days after I get there. Because my visa is already approved and the lease starts after my move is it legal for me to be on the lease?

I think it was the 'category 2' that confused things... there is no category 2. The categories are divided into the letters A-G. You will be applying under Category B.

However there is a Tier 2 work visa... which I'm guessing is what KFDancer thought you meant by category 2.

Nothing for me today...
I've also started following a Facebook page, uk spouse visa for usa citizens.  A gentleman just posted that his packet was received March 3 and he has received confirmation today that his decision letter has been sent.  Trying to find out if it's a priority package or not.  But, I'll take that as good news.  Fingers crossed!!!

If that doesn't work, you can just do a search for UK Spouse Visa for USA Citizens.  It's a closed group, but when you ask to join, they accept very quickly.

Thanks! End of the workday now and nothing today. Wasn't expecting anything. With how much is seems to have slowed down I'm not expecting anything this week. I take our dog next week to send him over. My husband will collect him at Heathrow. So hopefully my son and I will follow soon. It feels kind of silly that the dog gets to move before we can! But I understand why of course.
