Hoping to send my application in mid June!
« on: June 01, 2017, 04:06:31 AM »
Just posting to say hi, really. I had a spousal visa back in 2008-2010 but we lived in the US for the last six years so now I'm back at it again. I submitted my application last night and tomorrow I'm going to print out 150 pages of bank statements (hoping to get two to a page to cut that down a bit) at our local library and booked a meeting with our bank's branch manager for Friday to approve them. All this on top of packing up our crates; closing on our house; and a week-long work trip while caring for our 5yo over the next three weeks has made me an absolute wreck. But this board has been a comfort and resource that's helped me through a lot of it, so thanks, all! And good luck.

Good luck with your application :).

Do you have all the required financial documents from your husband too? You mentioned in a previous post that he was going back to the UK in april to start a new job, so I'm assuming you are applying under financial Category B on the VAF4a Appendix 2 form.

Remember, you will need:
- 12 months of his original payslips (US and UK) showing a total of £18,600 earned since June 2016
- 12 months of his original (or stamped) bank statements (US and UK) showing the deposit of every single payslip
- an original letter from his UK employer stating: current position and salary, length of employment, length of time earning current salary, type of employment
Optional but recommended:
- his original UK job contract
- his latest P60 if he has one

The latest payslip, bank statement and the employer letter must be dated no more than 28 days before the online application date.

What date have you booked your biometrics appointment for? You only have 5 days from biometrics to mail your application and documents to Sheffield.

Also, are you all sorted with your accommodation and relationship documents as well?

We normally advise not submitting your online application until you have every single document in your hands and ready to mail to a Sheffield, since that is your official application date.

Thanks! This is a helpful list. I have biometrics booked for June 12.

He started the job today so I'm applying under category A. He won't have a payslip for the current job until June 28, but all the payslips from April 2016-March 2017 will be submitted from his US job (with letter from the former employer). Basically, there is a two-month gap for the payslips. Do I have to wait until June 28 to apply then?

If he just started his job today, you cannot qualify under Category A. Do you mean Category B?

In order to meet the requirements for Category A, he must:
- have been with his current employer for a minimum of 6 months
- have been earning £18,600 at his current employer for the entire 6 months
- his employer letter must verify that they have been employing him at a salary of £18,600 or more for at least the last 6 months
- he must have 6 full months of payslips and bank statements from his current job

As I see it, you can only apply under Category B:
- where he has been with his current employer for less than 6 months
- his annual salary with the current employer is £18,600 or more
- he has earned at least £18,600 in total in the last 12 months
- he needs 12 full months of payslips showing a total of £18,600 before tax
- he needs 12 full months of bank statements showing the deposit of every payslip
- he needs a letter from his current employer stating his current salary and start date, and preferably his job contract

- he needs 12 full months of bank statements showing the deposit of every payslip
- he needs a letter from his current employer stating his current salary and start date, and preferably his job contract

That does make more sense when I read it here. But every time I tried answering the Category B questions--using the guidance--it didn't make sense when I filled it out the answers. So I went back to A.

Right now we only have payslips from March 2017-January 2011. There is a two-month gap of April and May between the two jobs.

The problem is that if you go with Category A, your visa is definitely going to be refused because you do not qualify under Category A.

I would print out Appendix 2 again and complete the Category B questions.

On Appendix 2, you complete as follows (assuming he has not worked in the UK at another job in the last 12 months:

Part 3:
3.3 - tick the first box and Category B
Complete 3.4 to 3.11
For 3.12, tick no.
For 3.13, tick no
Go to 3.20
For 3.20 enter the total he earned in the US in the last 12 months
3.21 - tick yes
3.22 - tick yes

And that's all you have to do for Category B :).

Right now we only have payslips from March 2017-January 2011. There is a two-month gap of April and May between the two jobs.

The gap between jobs does not matter for Cat B. You just need to show total earned during the 12 months - he could have been unemployed for half of the year and still earned £18,600 in the other half.

So, just provide whatever payslips he has from June 2016 to end of May 2017 and show that they add up to £18,600 or more before tax.

Gotcha. Thank you so much. I'm going to print a fresh copy in the morning and just clear my head.

Good luck! I applied under the same category with my husband starting his job in Scotland back in April. I am no expert but I have all my documents (photocopies) and got lots of help from ksand and KfDancer - also just got my kids' U.K. Passports if you're doing that for your 5 y/o (MUCH easier but still stressful) - so if you need anything pm me and I can send you my email address. I'm in Florida with my 3 kids so I feel your stress! (Awaiting my decision email any day now)
