FLR(M) HR letter wording...is this ok?
« on: August 14, 2017, 01:53:48 PM »
I just got my letter from HR and it seems oddly worded to me...is this going to be OK?

a) I'm worried that it sounds like I've only been employed fulltime, at the salary since 9 January, when I was in another position with the same pay, but different title for a year and a half before that. Does it matter?

b) I literally just got a raise, so the 6 months of pay-stubs added up and the salary amount quoted won't match. Is this a problem?

How long ago did you get the raise?

If it was less than 6 months ago, the letter needs to state ALL of the following:
- your current job title and current salary
- how long you have been employed by the company
- how long you've been earning your current salary
- your old job title and old salary (as this will determine if you qualify for the visa or not)
- how long you earned the old salary (as this will determine if you qualify for the visa or not)
- type of employment (full or part time, permanent or temporary)

If the raise was more than 6 months ago, the letter just needs to state:
- your current job title and current salary
- how long you have been employed by the company
- how long you've been earning your current salary
- type of employment (full or part time, permanent or temporary)

That tags to me like you have been in your current role since January, but at that company since July 2015.

My salary was a bit different as well due to a pay rise. So long as the pay slips and bank statements match up, and you meet the income requirement you should be ok. I just explained in my cover letter.

The raise is in effect only as of this month (August) which is why I assume she put it there (what it would say when she pulls my salary from the system). However, previous to this I still earned more than 18,600...the "raise" is only about £500/year. My 6 months of payslips will still add up to high enough over the 6 months, but they won't match the amount in the letter, does that make sense?

I had asked her to put that "through July 2017 the salary was X, and as of August 2017 the salary is Y" - so that it would match with my 6 months of payslips because the August one will be higher. Should I go back and insist on that?

It makes perfect sense, but the letter MUST state how long you have been earning the current salary... and since it's less than a month, it MUST also state the previous salary AND how long you earned it.

If the letter only says that your current salary is £X and you have been earning it since August 2017, UKVI will assume you don't qualify for the visa under Category A and may refuse it.

Yes, otherwise the visa might be refused.

I would make sure that the letter states EVERYTHING - a few months ago, someone was refused a spousal visa because they were using non-salaried employment, but their employer letter stated it was salaried.

Because of what was written in the letter, they calculated the salary from the payslips as if it was salaried and the visa was refused, even though they met the requirement with non-salaried income.

I remember that person. OK, I am going to write something up tonight that spells out my employment history with UofW and send it to her and see if she will just put it on letter head and sign it. Thanks, as always!

Ksand24, does this sound OK?

“I am writing to confirm that Mrs (me) has been employed on a fulltime, permanent contract by the University of Warwick since 20 July 2015.

From April 2016 through 8 January 2017, her job title was Programme Coordinator at a salary of £XX,XXX (more than £18,600) per year. Since 9 January 2017, her current job title is Group Coordinator, and her annual salary has remained £XX,XXX (more than £18,600). From 1 August 2017 her annual salary, as Group Coordinator, has increased to £YY,YYY. Her current position continues to be on a fulltime, permanent contract with the University.”
