Tier 4 switch to Spouse Help

I am currently switching my Tier 4 visa over to a FLR(M).  I arrived in September 2016 and we were married this August 2017. 

I have only been in the country for 13 months.

I just want confirmation that the FLR(M) is the correct visa to apply for, as my husband read through the website and has doesn't believe that I am correct and can apply under that category.  I assured him that I can, but I would like the back up of others to make sure I'm not confused and give him some reassurance. 

Can anyone please tell me if I am on the right track or not?

You're right. As long as your tier 4 visa is still valid (and you meet the other requirements), you can switch to FLR(M) from within the UK now.

He's probably looking at the rules as they apply to people entering the country on a settlement visa in the first place.

Yep, the form you want is FLR(M).

It's for people already living in the UK who are applying to either switch into the family/spousal visa path or who are extending a family/spousal visa.

From the spousal visa/FLR(M) webpages:

Your family member has a temporary visa as a worker or student
Apply to stay with your family member as a dependant if they are in the UK on a work visa or student visa.

And

How to apply
You’ll need to prepare information and send documents with your application.

How you apply depends on whether you’re outside or in the UK.

Outside the UK
You must apply online from outside the UK. You must also complete Appendix 2.

There’s a different way to apply in North Korea.

In the UK
You can apply online if you’re already in the UK.

You can also apply by post or in person at a premium service centre.

How you apply by post depends on whether you can prove your knowledge of English, meet the minimum income requirement and currently have permission to be in the UK.

Fill in:

- form FLR(M) if you can meet the requirements
- form FLR(FP) if you can’t meet the requirements

Thank you so much for your replies so quickly, he is in panic mode---more than me. He's heard horror stories and has started looking up information, not knowing what he is looking for, bless him. And all he does is get himself worked up...and make me question if I'm doing things correctly.

Yup that's the visa you should apply for, I am doing the same thing :)
