Spousal settlement - reapply

Hi all!

As some of you know we have been denied our visa based on paperwork for sale of property being not accepted on a $35k deposit. Couple of questions.

1. We will have held the funds ($74k and $35k)for 6 months as of May and were wondering if there was any waiting timeframe to reapply other than the 6 months for funds to be held? Not sure if reapplying applicants have a cool off period of sorts.


2. Also we are closing on the sale of our home as of end of March. We have $74k already for six months  as of March. Would you suggest / deter us from using the sale of the home (net proceeds of $20k) to reapply with our situation?

I am okay to wait the extra month or 2 if need be but I wanted to get everyone advice. We are currently living with family and don’t want to have any extra time if we can avoid.

No, there's no required waiting period before applying again after a rejection.

I will let someone with more experience comment on the second part of your question.

You can reapply as early as you'd like.

Just keep an eye on the exchange rate.  If you have a nice cushion with the sale of the property in March, no problem applying then.  :)

I ask because our rejection letter mentions proof or relationship and said no issue. Then financial -issue but it never mentions accommodation. I plan on sending in basically the same package but with updated financial paperwork. 


Should I worry about the accommodations not being right in the original package if not mentioned?

While one would *hope* that the rejection letter will cover the full application, we have had members caught out by this.  Someone was refused for applying in person on a visitor visa and was told that everything else was fine.  They returned to the USA and reapplied, but were refused (correctly) for financial reasons.  It was very unfair that UKVI led them to believe on the day that the only issue was having applied from within the UK.  When you pay as much money as you do, they really should have given correct information regarding the rest of the application.

That being said, hopefully they fully evaluated your application.

Land registry paperwork from local solicitor (it is stamped on page 1 with the word copy but apparently that’s what the solicitor had to do)

Copy of mortgage statement

Is this okay? Should I correct something?

Yes, you will.

You have to re-do biometrics for every single visa you ever apply for (including if you apply for UK citizenship now as well).

You'll also need to list the date and location of your previous biometrics on future application forms (mainly when you apply from inside the UK later on).

The reason is three-fold:
1) to get updated biometric information from you
and
2) to confirm the same person is applying each time
and
3) to confirm you are who you say you are

Im going to stop creating new threads and just build off of this one. I was doing some research and found the SU07 form - Sponsorship Undertaking form and was curious if this is something we need to be filling out?

Can someone clarify when you would use this?

You don't need it. It is used for adult dependant relative visas.

Don’t do anything :). The less you add to it the better.

No plastic wallets, no binders, no files, nothing... because the first thing they’ll do in Sheffield is take everything out of them, which gives them extra work to do.

Just place it all in sensible piles and place in the envelope. You can secure the sections with a paper clip or rubber band if you like, but nothing more than that.
