18 year old US citizen moving to UK
« on: August 18, 2009, 10:35:46 PM »
Hello everyone
I am new and I desperately need some advice

My boyfriend is a US citizen, currently residing in the USA and Im an EU national with indefinite leave to remain in the UK. We want him to move here as soon as possible to work for a year and then go into studying undergraduate degree.

We have looked into taking the marriage route but we cant since we are 18 - limit is 21 years old. What can we do? Are there any programs which sponsor work permits or..? Please help

Student visa would probably be your best bet.

No.  Sorry to be blunt, but if he's not ready to start university then he can't get a student visa, and he won't be able to get a visa to work in the UK.  I don't think he qualifies for BUNAC since he's not a student or graduate yet, and there's no way he'd get a Tier 2 at the age of 18 with no qualifications.  He will either have to start uni right away or work in the US until he's ready to start.

As historyenne said, it would be unlikely for him to qualify for the tier 1 and or tier 2. If he were to go the student visa route, he would need to apply to a UK university, receive acceptance, and show proof that he has the funds to pay for school and living expenses in order to get the visa. Look onto the UCAS website, he might be able to find a clearing spot to attend school this fall. If not, he would have to wait until next fall.
09/29/09--Visa Approved!
10/05/09--Leave for the UK!!!
06/15/12--Back in the US indefinitely...

Impossible, actually. :( He'd fail on the educational requirements just for a start.

I didn't think people using EU law fell under the age requirement?
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012
FINALLY A CITIZEN! 29/2/2012

I don't think they do, but I'm not 100% positive about that.

Surely the under-21 thing is just a British rule?  Could be a possibility for the OP...

You can get married in the US if you're 18. It only took 24 hours for me to do it in New York and my husband is French. He came to NY on a tourist visa. We then applied for an EEA Family Permit to get me over here to the UK. The UK recognizes the US marriage certificate so I would expect that to be sufficient. However, I'm not familiar with how the 21 age limit in the UK would affect the decision. The application is free, however, and it only took me 24 hours via courier to get it approved in NY so it's worth a shot if your other routes don't pan out.

6/26/2006: Met hubby in NYC and start dating
9/9/2006: He leaves for France :( Long distance relationship ensues
2/17/2009 - Moved to London on Tier 2. Huge mess with Tier 2 and Tier 1 visas ensues
4/15/2009 - Get married in NYC
4/16/2009 - Complete online EEA Family Permit Application
4/21/2009 - Complete Biometrics and submit to courier
4/22/2009 - EEA Family Permit visa issued! :)
4/26/2009 -  Back in London! :D :D :D
8/10/2009 - Submitted EEA 2 App
8/26/2009 - Obtained EEA Residence Card! ;D ;D ;D
