Urgent - abandoned residency
« on: April 30, 2008, 09:23:07 PM »
Long story short:

I have a greencard. I've been out of the country for 18 months, without requesting 'permission' (I can't remember what it's called!). I presume my greencard is abandoned, that's fine, I know I will probably have to re-apply when we move back to the US and that's OK.

However my husband is in the US right now and we decided last minute to go visit him, we leave Saturday for 2 weeks. I'll be going myself with my 2 US-citizen children.

So 2 questions:
1. Do I go through the citizen line at the airport since I'm with them?
2. Do I present as a Permanent Resident and explain the situation and that I am happy to enter on the visa-waiver? Or do I just attempt to enter on a visa-waiver from the get go? I am happy to surrender my greencard.

As I understand it, your green card expires after a year. Period.

So no, I wouldn't try to enter on it.

Thanks, obviously with leaving Saturday sending a form off isn't an option!

I called the USCIS and they advised me just to enter on a visa waiver and surrender my greencard to the immigration officer.
