I went to the US Embassy today and got a second passport.  It was no problem, they had a checklist that was on the web and I met all the checks.  I'm feeling a bit patriotic now that I've had some government organisation help me in a way that makes sense and didn't cost £900. 

UKVI still haven't returned my old passport.  'Nuff said about that for now, I'lll save the rant for later.

Glad to hear it worked out eventually, jimbocz. Also happy to hear you had a relatively painless experience with one government agency.  ;) Good luck with UKVI when you get back!

Hopefully you're more relaxed now and can have a nice time in the US.

One day before I am supposed to leave, UKVI have returned my passports.

They included a letter saying that they will pause the application until I return those passports within 28 days. 

I'm going to travel on my new second passport, carrying my old expired passport that has the ILR stamp. When I enter the UK, they will stamp  that passport with a stamp that says they saw the ILR visa in second passport.  I'm hoping that after I return the two passports back to UKVI, I'll be able to go to France on my second passport and it will be fairly legit with that stamp.  Once in the past we forgot to bring the passport with the ILR and the Border Officer told us that it was OK since there were ohter stamps that said I had a visa in the second passport.

Drama over.

Just for posterity, when I entered, I asked the border guard if I could travel to Paris with just my second passport and a photocopy of my ILR.  He was totally cool with that.  He really was excited by the stamp that says I am the husband of an EEA national and really wanted me to copy that.  (Good call Larrabee! )
He also said that any border guard could easily confirm that I am applying for a BRP and I shouldn't worry about it.
