Yeah, there's always someone challenging the requirements and the Home Office always gets their way.  Thousands of families are separated at the moment.

Dustin, first let's see what they send back.  It's been a while since we've had one of these.  But the short answer is yes, you can reapply and ask them to consider the new application and take the old one off hold.

No, a couple of years ago. It's actually worse for them, or it was last time because they had to wait all that time not knowing, only to find that nothing had changed as the rules were upheld.

Yeah, applications were put on hold for months and months (up to a year, I seem to remember), while they waited to see if the £18,600 threshold would be overturned... it wasn't, so all the applications were refused anyway, even after all the waiting.

Online visa app 24 April 2017 (Priority)
Biometrics 5th May 2017
App tracked and received Sheffiled 10th May 2017
Email confirming receipt (of online application) 25th May 2017
Email asking for passport, appendix 2 etc (which has all been sent) 30th May 2017 (Discovered solicitor may have advised to send to wrong processing centre address - letters, and phone calls - still unclear).
Confirmed receipt of docs 17th July
Return label requested and emailed 17th July
Decision email 26th July
Visa 28th July

Could this (any income counting advice) relate to the high court ruling which I believe relates to just that, broadening out what income counts where children are involved - and hence the on hold for that decision to be applied?

That Ruling agreed with the UK on the financial requirement to sponsor.  They only asked that the government reconsider where there are children, not that they must change. The UK is reconsidering, but doesn't have to change.

Has your wife returned to the UK? Or is still in the US?

If in the US, has she earned 18.6 over the last year?

If in the UK, does she  earn 18.6 to be able to sponsor you? Or earn enough to be able to sponsor your using your savings too?

18. Letter from Aeropeople, Cambridge

Have they offered you a job and would they sponsor you for a visa?

Also i now have a rental income of about $1400 a month so i know i could make the limit


If that property is in UK, do you intend to live in that property?

I couldn't work out how you have a property in the UK that you rent (mortgaged?) and a letter in your application to say that you will live at your in-laws house.

If the property is in the US, do you intend to sell that property and have you got any equity in it?

They used an attorney who had them include a bunch of unnecessary stuff but didn't check their current circumstances and told them they qualified now.

I write this just to give you some semblance of perspective.  I do, however, hope they sort your application soon, or at least give you some type of information that you're able to work with.  Good luck.

Thanks everyone! My wife is currently here she has a job offer letter from her previous job. She hasn't worked while we have been in the states hence why she can't sponsor me. Also the house we are renting out is one we bought here in the US

The response is out from the government, in the Statement of Changes in  Immigration Rules.
