meeting foreign residence/presence tests
« on: June 12, 2007, 10:16:32 PM »
Hi everyone -

I'm filing form 4868 for a little more time to do my return.  I moved here in April of '06, so have US income for the first quarter, basically, and UK income after that.  I see frequent referral to these tests but don't see links or further info.  For example, on the 4868 instructions:

If you are “out of the country” and are a U.S. citizen or resident, you may qualify for special tax treatment if you meet the foreign residence or presence tests.

I mainly want to meet my foreign earned income exclusion requirements.  Where and what are these tests?  Will I meet them?  Do I need to file for an extension to meet them?  I'm sure there's a link, I just don't find it in any logical place ...

Thanks in advance,

Jason

The IRS explain this really well here:

If you are freelance the maths is a heap more complicated on the 2555 and 1116 forms, but in a nutshell if you moved in April 06 you may well already have 330 qualifying days by now... you can still file a 4868 now if the return will take longer than June 15th
