When can I apply to extend my visa?
« on: October 03, 2021, 12:26:16 PM »
I'm really confused as to when I can apply to extend, my brp expires 25-07-2022. I landed in the uk on my spouse visa 19th November  2019. Do I apply 3 months before my brp expires? Any help is appreciated. I'm more nervous this time then I was the first.

The earliest date you can apply is 28 days before you reach 30 months in the UK and the latest date you can apply is the expiry date of your BRP.

If you entered the UK on 19th November 2019, then you will reach 30 months in the UK on 19th May 2022 and 28 days before that is 21st April 2022.

Therefore, your application window will be 21st April 2022 to 25th July 2022... and you can submit your online FLR(M) application on any day between those 2 dates.

No need to be more nervous than the first time... you've already done this once, so you have some practice already, and as long as you still meet the visa requirements and can provide all the required documents, there's no reason to think you won't get the new visa.

I wouldn’t apply until the beginning of June 2022. But no later than your current BRP’s expiry.

You just have to have applied before it expires, not necessarily be granted the new one.

You just want to ensure you don’t apply too early so that your second visa takes you to the full five years (minus 28 days) from when you first arrived on your spouse visa.

For example: if you applied now and say your next visa was granted in Jan 2022, it would expire 2.5 years (30 months) later. So it would expire around July 2024, which is before you are eligible for indefinite leave to remain. This would mean you’d have to apply for another flr(m) and all the expense that entails because you applied too early.

No need to be nervous. Just ask your questions in this thread as they come into your head.

Are the documents much different this time? I know I need to show bills or statements with my name and address this time.

The financial and accommodation documents are pretty much the same this time, but the relationship documents are slightly different, in that instead of providing evidence of keeping in contact while living apart, you provide evidence of living together in the UK.

So, you will need the following:
- 6 item of mail in each of your names spread evenly over the last 2 years before applying (i.e. 1 item of mail dated every 4 months)
- they can either be jointly addressed or individually addressed, but if they are individual, you need 2 items from each 4-month period... one in your name and one in your spouse's name
- they must be from at least 3 different official sources (i.e. bank statements, utility bills, phone bills, tenancy agreements, council tax bills, letters from government departments like the NHS, DVLA, HMRC etc.)
- they must have been received in the post in the months they were issued... online/electronic statements or bills are not acceptable as they do not prove you were physically living in the house in the months they were issued.

So, if you were to apply in June 2022, then you will need 1 item of mail in each name from each of the following months:
June 2020
Oct 2020
Feb 2021
June 2021
Oct 2021
Feb 2022
June 2022

or alternatively, you could use the following months:
May 2020
Sept 2020
Jan 2021
May 2021
Sept 2021
Jan 2022
May 2022

So I'm getting my proof of living together things together. Our electric and gas bills show multiple months at a time? Will this be an issue? Do I need them to break it down into single months somehow?

No, but you’ll only be able to use each one for the month in which the bill was actually issued and received in the mail.

For example, if you have a bill that covers January to March 31st and the issue date of the bill is March 31st 2022, then you can only use it as mail evidence for March 2022.

I can use either sent of dates you sent for the correspondence correct? Would paperwork mailed to me from my home country count? Also because our house was built on a new estate our electric still shows us as a plot number, But also shows house number and street postcode, will this be a problem at all? Thank you so much for your help, getting all this together and having a second wedding ceremony new years eve is gonna make my hair fall out from stress
