FLRM: Expedite Visa

Hello,

Does anybody. know why on my FLRM visa application, I'm not getting the payment option to expedite my decision process.

I'm nervous that my current  FLRM visa will expire before the decision is made for new visa. What will happen if this happens? Will I need to leave the country? Can I continue to work?

You just need to have applied before they visa expires, you don't need to have had a decision by then. As long as you've made a valid application, your current rights are maintained under section 3c rules. But if you look at 1am, you should find a slot.

What do you mean when you said  'find a slot after 1am'? Is this in reference to expediting my application?

No, once you have applied, you cannot leave the country, because it will invalidate your application. Also, Section 3C Leave only extends your immigration status after visa expiry while you REMAIN INSIDE the UK. As soon as you leave, Section 3C becomes invalid and you lose all right to live in the UK... which would mean returning to the US and starting over from scratch with a new spousal visa.

So, once you have submitted the application, you cannot leave the UK until your FLR(M) has been processed and you have received your new BRP card.

Yes. The only way to expedite the application is to pay £800 for Super Priority service, which gives a decision within 24 hours of biometrics.

However, you can only purchase it at the time you submit and pay for the visa, but there are only a small number of slots available each day (I think around 50 or so)... so if it does not give you the option for Super Priority when you try to submit, that means all the slots are gone for that day.

New slots are released at 1am every night, so, what you need to do is log on at 1am and try to submit your application then... hopefully it will give you the Super Priority option. If not, you just need to keep trying each night until it shows up.

So, let's say I pay for the 24 hour expedited option at 1am tonight does that mean that my biometric appointment will be 24 hours later... sorry I just got a little confused when you said... "which gives a decision within 24 hours of biometrics.'

Just checking - in a previous post, you mentioned your visa was up in June 2022?

I'm assuming you still haven't taken and passed LITUK, which is why you're applying for FLR(M) instead of ILR? If you've since taken the test and passed, you would be eligible for ILR instead of FLR(M).

No, you're just purchasing the Super Priority service at 1am. That service will not be applied until you actually attend your biometrics appointment, which you will book after submitting the application. Once you have attended your appointment, the decision will be made within 24 hours.

So the order of doing things is:
- complete application
- submit and pay for the visa, including purchasing Super Priority (this step must be done before your visa expires)
- you will then receive an email with a registration code for the UKVCAS website
- register with the UKVCAS website
- book a biometrics appointment... you may need to pay for this (up to £130), depending on what type of appointments are available and where and when you want to have the appointment
- if you wish to upload your documents yourself, you have until 2 days before your appointment to upload and submit them
- attend your biometrics appointment... this is where Super Priority will be applied
- within 24 hours of attending the appointment you should receive your visa decision by email (some people have been getting the approval within about 4 hours of the appointment
- wait for your BRP card to be mailed (takes up to 7-10 days)

Why have you applied for FLR(M) and not ILR? Looks like your last FLR(M) was granted in March 2020? So your current BRP won't expire until September?
