ILR eligibility
« on: August 28, 2022, 01:12:23 PM »
Hi!

It's nearly time for me to apply for the Indefinite Leave to Remain. Just a quick question to see exactly when I'll be eligible to apply. I read on the UK gov website that you can apply as early as 28 days before your eligible date - a) is that accurate, and more importantly b) how can I determine what date I'm eligible?

I will provide a few dates....

I entered the UK on my spousal visa on December 22, 2017

I don't have the exact date, but my FLR(M) was approved in either very late November/early December 2020.

The expiry date on my BRP (if that's relevant) is June 23, 2023.

If the date my FLR(M) is important I will try to track it down again but I can't seem to find the email associated with the approval nor the paperwork.

And am I correct in the understanding that I will be able to apply for my British citizenship immediately upon my approved ILR?

Thanks!

***Quick edit....I might have found my answer? The Gov website actually says "The earliest you can apply is 28 days before you meet the requirements for the time you need to have lived in the UK" - since I'm on the 5 year route, the 5 year mark would be December 22, 2022. Does this mean I can apply 28 days before that? Which would be.... November 24, 2022?)***

Yes, 28 days before the 5 year anniversary of you entering the country. As soon as you have your ILR BRP you can apply for citizenship.

Ok thanks for confirming! Do they have priority/rush service for the ILR? I know they did for the other steps along the way so I'm hoping so. And am I correct in the belief that I would be unable to leave the country while the application is being processed?

Yes, you're stuck here while it's being processed.

There is a priority service. To find it, you need to sign on at 1am as that's when the slots are released. If you don't see a slot, wait because if you go on without one, you won't then get a chance to add it later.
