ILR - previous marriage question
« on: May 18, 2023, 12:53:32 PM »
Hi all,

I'm filling out my ILR application. I've been here over 10 years but also almost 5 on a spousal visa but I gather the applications are exactly the same? I didn't really give me an option as to what route I was applying under - it just has my time in country as 10 years 8 months.

That being said - in my previous FLR apps it asked about previous marriages and I had to provide info and divorce certificate in document checklist. I just want to make sure I'm not being daft and somehow missing this section as it hasn't asked me this info this time. Does it normally?

The FLR application probably asks about previous marriages (and for proof they have ended) to ensure the authenticity of your marriage to your current spouse (and that you aren't trying to use a "sham marriage" to immigrate or commit bigamy). That is not relevant to the ILR application, so I wouldn't be surprised if it doesn't ask about previous marriages like your FLR applications did.

It is absolutely relevant to an ILR application if you're applying for ILR based on your partnership.

SET(M) and SET (LR) aren't the same application. The first is after the family route, the second is based on long residence across any set of eligible visas.

Did you see the changes to the 10 year (LR) ILR last month?
