Settlement Visa
« on: July 18, 2023, 04:45:14 PM »
Hi All

Quick bit of advice please, i cant find a clear answer googling around

MY wife last year got her Settlement / Indefinite Leave to Remain Visa and we were under impression that was it no need for anything else.  We only just noticed today that it expires December 2024.  Does she have to go through a whole host of paperwork / cost to renew again?

Thanks in advance

They are doing away with BRPs then, it's all going digital so nothing to do at that time, I don't know if there will be at some point in the future. That would be one of the benefits of getting citizenship, you wouldn't then have to keep up to date with any changes in the immigration rules.

No, you're right.

Time you’ve spent outside the UK
To be eligible, you should not have:

spent more than 270 days outside the UK during the 3 years before your application
spent more than 90 days outside the UK in the last 12 months
You may be exempt from the residency requirements if your partner works abroad either for the UK government or an organisation closely linked to government.

Don't worry about her BRP -

You do not need to tell UKVI if your BRP expires on 31 December 2024 but your immigration status (for example, your visa) allows you to stay longer.

You will not need a BRP from 1 January 2025. You’ll be able to prove your immigration status online, without a BRP.

UKVI will update their information on how to prove your immigration status in early 2024. You do not need to do anything and your immigration status will not be affected.

Lots of people remain on ILR, for various reasons e.g. their country does not allow dual citizenship
