Name change back to maiden name

Hello! I'm hoping someone might be able to help, and I apologise if I'm posting in the wrong place...

I currently hold ILR, which I was granted in 2019. My former partner and I are now separated and in the process of going through the divorce.

My question is, when we got married, I changed my surname to take his, but would like to go back to my maiden name... in order to do this, will I have to wait for the divorce to go through before changing my name back?

And also, what would be the process of notifying the Home Office of this and getting a BRP issued in my maiden name? As well as my passport?

Honestly, I'm not sure.  Easiest thing to do would be to email the US embassy.  They are very good at responding quickly.  As you don't have a UK passport, you would need to change the name on your US passport first, and then on your BRP card.  I'd start with what paperwork (if any) is needed for the US passport. 

I'm hopeful for you, that since you are reverting to your maiden name, you don't have to wait until the divorce is final.  But I genuinely do not know the answer.

I've done some digging online and I believe I can use a deed poll to change my name, which is accepted by the US embassy to change my passport

I am struggling to find how I would notify the HO of my name change and what is needed for that in order for them to approve and issue a new BRP?

We used to be able to use a Deed of Name Change, to avoid using a Deed Poll.

You can change your name at any time. I don't know when the best time is to do this because of the names on divorce papers. I assume (hope) you are using a solicotor to check your financial settlement? Can you ask her (or him)?

We aren't using a solicitor as we don't have any financial ties to eachother any longer now that we've sold our house, and are on good terms in regards to what we agree on the divorce and everything, we've only opted for a financial order as part of the divorce,  which we've agreed on

My main query I guess is once I've managed to change my name in my US passport, what would I need to show the home office in terms of documentation that my name has changed on my passport via deed poll?

I suspect you can change your name on your BRP simply by having your US passport changed.  Along with your birth certificate and marriage certificate, that seems more than enough evidence of your choice of name.  The important part is not how your name was changed, but proof that you are USING your maiden name now.  Pretty interesting and logical - quite a surprise!

Hiya, so sorry for the late response, but I've just sent off my Passport application with my deed poll to change my surname back to my maiden name, as the embassy website instructed me to, so assuming that goes all okay and I'm able to change my surname there and my new passport is issued in my Old surname, I understand the next step would be to change my surname on my BRP, however when I've looked up the guidance on the GOV website for this, I saw a section about documentation to show your continued residency since settlement was granted, which I'm assuming would be since I got ILR?
I've moved house and jobs a few times since I was granted ILR, so I'm just curious about how the best way to go about this... do you have any advice?

But looking at it again, is the original document showing grant of settlement my BRP? As I don't believe I have any other documentation relating to that
