Topic: Has anyone made the switch from EU-Settlements Scheme Pre to Settled?  (Read 1284 times)

Hi guys it's me again.

The recent talk of rising costs for spouses etc has me spooked https://iasservices.org.uk/uk-government-makes-radical-changes-to-family-and-work-visa-requirements/

My wife is currently on a EU Settlement Scheme with Pre Settled Status (Shes an American married to me, Northern Irish with Dual UK/Irish citienship) she arrived initially under a UK Spousal Visa in April 2019, then switched over to a UK Settlement Scheme Pre-Set Status in Dec 2020.

I was wondering if the proposed changes re income will impact us? Or has anyone else jumped over to settled status yet? What was it like and what did you have to send?

Also regarding my wife's time here, would this mean we could apply for Settled Status in April 2024?

Your wife is under the UK's EU Withdrawal Agreement and not on a spouse visa, FLR(M), or work visa. Therefore the link you gave does not affect her.

A few on here have used an EEA citizen to obtain the UK EUSettled Status in UK but what they sent would have depended on the status of their EEA sponsor.
e.g. if their EEA sponsor was not part of the NI rules and they had rushed ahead to get British Citizenship, their non-EEA dependant would have been caught by the Lounes case. They had a long form to complete and extra proof to show their EEA sponsor was exercising treaty rights in the UK (working).
