FLR > ILR Timing Question

Hi:

My Partner arrived on September 11 2019
She renewed her Visa to FLR after 2.5 years in April 2022
Her next stage is ILR
Her physical BRP visa says it is Valid until 01-11-2024.

What is the latest and earliest  she can apply. Thinking out loud 5years - 28 days is Aug 2024?
But where does the 01-11-2024 expiry come from on that basis?

The earliest date she can apply for ILR is 28 days before she reaches 5 years in the UK (28 days before 11th Sept 2024) = 14th August 2024

The latest date she can apply is the expiry date of her current BRP card = 1st November 2024

So, she can submit the online ILR application at any time between 14th August and 1st November 2024.

If we have a 8Sept-13Oct trip planned, would you agree these are options?

Apply on 14th Aug and pray for a fast track slot? If this doesn’t come, can we then wait till November or are we commited?

I would say it'd be safer to wait until October, after your holiday. You can fill out and save the application in advance and then submit when you get back to the UK.

Applying on August 14th could be risky, as you can't guarantee that you'll get the visa in time, as it can take a couple of weeks or more to get a biometrics appointment, and then after the appointment, it can take up to 10 days to receive the new BRP... and you can't travel while you have an application pending (leaving the UK after applying but before getting the visa will invalidate the application).

I would get everything prepared before you go away (you can start the application and just keep saving it until you are ready to submit), and then apply as soon as you get home.

Yes, it can be taken at any time in the 5 years leading up to ILR - she just has to make sure she has passed it before she applies.

I would recommend she gets started on preparing for and taking it ASAP, so it's out of the way in good time and she's not rushing to get it done last-minute.

Hi. Thank you for the life changing help over the last 5years. I am starting this now.
If I start readying the application, I can submit for Super Priority the day we arrive back in October ?
