I just called the US embassy in London earlier this week (9th thru the 16th) and the lady that I talked with was a little snotty but helpful all the same.....
Our situation is just simply that it's just not working here, we've been here 5 months and it's just not happening...the stress etc is too much to handle, and we need to go home to the usa.
She told me I needed to file an I-130 form, from here if i'm living here and from the usa (to the usa) if I'm home by the time I file for my husband.
I did mention having a job and address, it doesn't seem to matter, I can use my parents address, and well, when I get a job I get one.
But, lo n behold, although I thought my spousal visa was holding me here, it's not. (thank god) So if hubby and I do have to spend some time apart, we're not overly fussed, but hoping that it is on the lower end of the wait than the longer.
Just what I've found out, don't know if it'll be relevant to you or not. :)

yes but... when you go to apply for a NIN they say come back when you have a job... seems they don't want to be bothered making sure your eligible to work in the u.k... they want a prospective employer to jump thru those hoops... but it is true you can get a job without one... IF you don't mind giving the government a third of your wages in emergency tax... granted you get it back when you get your NIN but DAMN!!! it hurts while your waiting

All you should have to do is prove you are job hunting. That's all I did and as far as I'm aware, that's all that is legally required. I did NOT have a job when I got my NIN. If your local office is doing that to you, then find the offical government language that says otherwise and show it to them. (sorry, if I had a link for it, I'd post it myself but I never needed it!)
