Marrying in America - Staying in America
« on: February 13, 2005, 01:28:06 AM »
I realise this is a website for Americans living in UK and my questions are for the opposite but I was hoping someone could guide me to the right place for the answer(s) if it can't be answered here.

Ok well I have been going with an American citizen from Colorado for nearly 2 years, she is still currently married but divorce should be completed within the next 3month from today.

We now plan on moving to the USA permanantly and want to get married in the USA.  Just now Jennifer (My partner) is living in the UK under the visiter visa which permits 6months here in the UK.  We plan on moving back to the USA on the 6th of April.  Now I am under the impression that to make things easier and cheaper I should withold giving the impression to immigrations that I intend on marrying whilst there on the US visa waiver.

I want to know if we do this and get married within the 90 day visa waiver (assuming she is divorced) I would from then be allowed to apply for permanant residency so I could be allowed to stay in the USA without having to leave whilst the application is in progress?  And also if I am allowed to work once the application has been sent?

Can someone please clarify if this is correct please.

MUCH APPRECIATED FOR REPLIES!

Jamie

You could try this website:   http://britishexpats.com/
There are regional sites where you can ask questions to other Brits around the world.

Ok, I hope it helps.  There is a forum on there where you can speak with other Brits.  Some other people on the site can probably give you some info on this area, but I know that my knowledge in this area is very little.

You may want to check out Visa Journey, a GREAT web site for those who are trying to get family-based visas to live in the states.  www.visajourney.com

Everyone on the forum know their stuff (mostly) and can offer great suggestions.

Good luck!

just to let you know there is a way to stay in the usa without going the whole fiance/spouse visa way... it's still legal but it's a little skewed... on the fence ... loophole way...  as long as your married to your american...pm me and i will fill you in...
btw... i am not a lawyer... the information i give may not be totally spot on right but more the impression i get from things i have researched... as you know sometimes the legalspeak can get confusing so i'll give you links to same places i looked up the info... then you can decide if my impressions are yours as well
It's the difference between knowing the path and walking the path.

She wasn't kissing your lips my darling

What's it gonna be Merv?
Interesting deal
She'll do it. If she has to kill everyone in this room. She'll do it. She's in love.
*sigh*
It's amazing how the path of love is so alike to the path of insanity
