Not able to work due to illness!

I'm not too sure where this should go (forum wise) and to keep it short and sweet the problem is this:

Hubby had offer of job when we applied for his spousal visa and he's been over here now since June! In July he ended up in hospital quite poorly and they have now found out he has a heart condition that no longer allows him to do his line of work.  In fact, they have said he's not to work for a while until they get him much better and find the right medication that his body will take and let him lead a 'normal' life.

Now my problem is that, yes, I can work, and yes, we do have a bit of savings put by, but with only one wage coming in, its going fast! 

I also am aware that hubby is not allowed to claim for benefits.. but everything has changed since his illness..............will we now be able to get him some benefits of any type at all??

Its a bit of a worry, not so much short term, more long term and I need to find out what our options are.

If your husband does not have ILR, Indefinite Leave to Remain, he is NOT eligible for ANY public funds at all.  That includes 'benefits'.  The website www.dwp.gov.uk can give you a list of everything that's considered a public fund.  Falling ill does not change a person's visa status, or his entitlement to benefits.  It's just bad luck, unfortunately.

YOU, as a British person, can claim what you like, however, on your own and on your own income.  For example, you can claim housing benefit in your name, or top up a low income with tax credits, council tax benefit, etc.  Since you'd be the sole earner, these benefits will take this into account.

A trip to the Job Centre may be just the thing, since many benefits are now administered from here.

No.  Not unless the spouse has been married to the UK national for a minimum of a) 4 years if living abroad b) 2 years if living in the UK.  Otherwise, it's Limited Leave to Remain.

We have been married for 10 years and have never lived in the UK. I just applied for my citizenship and received it in December of last year. Do you know if this has any affect on the ILR?

Here where , in the States or the U.K?...if it's the U.K and he has ILR then, then go for it.......

If he is unable to work for at least a year, your husband may be eligible to apply for US Social Security benefits (I am assuming he has worked somewhat recently in the US).  In any case the only way to find out is to contact the Federal Benefits Unit at the US Embassy.  Here's their contact info:

If you have citizenship, you dont need to worry about ILR.  You have a maroon passport and that trumps ILR.
