Green Card
« on: November 23, 2005, 03:20:31 PM »
I am American & my husband is British.  I have a spousal visa as we live in the UK.  Our plan is to move back to the States in the next year or two.  Can I start the process of getting him a Green Card before we actually move?  And if so how?

Any help would be great.  Hope everyone is having a good British Thanksgiving.

 :)

You have to file all of the paperwork before you leave, he can't "live" in the US without a green card, just visit.  We went the fiance route, but there were a few people who got is after being married.  Hopefully they'll get back to you. Good luck.

Hi, I just wanted to say good luck.

I repatriated in Sept. 2004 w/ my husband and two children after living in England for eight years.

The best place to start researching is on the US Embassy website where all of your questions can be answered.  Don't be put off by the sheer volume of information.  There's a lot to sift through and everybody's circumstances vary.

http://www.usembassy.org.uk/cons_new/visa/iv/index.html

Once you officially file your petition, the process takes 4-6 months depending upon the complexity of your petition and the volume of petitions the Embassy is currently processing.

Assuming that your spouse is granted the visa, you then have six months in which to leave and enter the US.

Good luck!
