I'm very new to all of this so if I say something ignorant, please forgive me.

In order to qualify for the spousal visa is it a must that I'm already living and settled in the UK? Our tentative plans are to eventually marry here in the US, and then for him to go back over to the UK and hopefully acquire a flat (he lives with his parents at the moment and that will help with saving money in the meantime). I have pets that I'm taking with me and need time here to get them ready to go over (several birds and a dog). I'm hoping that I can work for a while here before going to the UK to also help in saving money for the pets and to help with moving, etc.

Will working here for a few months before joining Richard in the UK cause problems when we apply for the spousal visa? Can we apply for it while I'm still in the US?

I've read the site and have to admit that I'm just thorougly confused at this point. I think I've overloaded my brain with visa information. We're also carefully researching the pet situation so it's just gotten VERY overwhelming at this point.

I'm pretty sure of the steps we need to take but the ORDER in which to take them is complicated. Having pets isn't making it any easier. If not for them, I would just fly back to the UK with him immediately after marrying and we could stay with his parents until I found a job and we found a flat. But there is no telling how long that might take and I can't leave my pets with my parents indefinitely. Especially the birds.

Maybe an outside view would prove to be helpful? It would definitely be appreciated!

It is probably easier (and cheaper) for you to marry in the US and then you apply for leave to enter the UK as his spouse.  He can either be already in the UK or travel over with you.
