Irish citizen wife, US citizen husband, moving to UK
« on: December 23, 2005, 11:18:22 PM »
Hi everybody,
This is my first time posting here. It looks like a very informative site but I haven’t been able to find an answer to my question so thought I would post one of my own.

I am currently a student in the USA but am from Ireland, am a born Irish citizen. My husband-to-be is an American citizen.  We want to move to the UK. I know that I can go there any time to work or attend college or just to live, based on EU citizenship and as well as that, my mother was born in England. My question is- what about my fiancé, in terms of how he can get there and live with me?  I can’t find it in writing anywhere that states as an Irish citizen how I can bring him to the UK, and even if I can, whether he MUST be employed or can simply attend college or if I am allowed to support him entirely.

Surely there must be some legal relationship/benefit to being Irish and wanting to live with my husband or fiancé in the UK? And if there is an answer to that, I would like to know if fiancé or husband is better option.
I appreciate any comments and help.
Regards.

You can bring him to the UK with you to live no problem, but I'm pretty sure you wouldn't be able to until after you were married.  I'm not an expert, though, but I'm sure someone more knowledgable than me will come along soon to answer your questions!
Now a triple citizen!

He needs to apply as the spouse of an EEA citizen.

Thanks so much for your kind replies. I am reading some more on ukvisa sites and unless I am mistaken my husband (we should get married before applying for UK VISA) needs to apply with a VAF2 form. Is that correct? Also is he going to get a settled status once VAF2 is approved?

Regards,

You have a choice.  You can either apply with form VAF1 which would be the form for the spouse of someone present and settled in the UK, or you can apply with form EEA1, which is for the spouse of an EEA national.  The latter application is free of charge and is easier to aquire, and gives a few more rights to your partner.

If you have been living together for 2 years then you would not need to marry for your partner to apply.
