I-130 and K3 Visas
« on: January 06, 2006, 02:24:41 PM »
So we've decided that we would have a better chance of starting off in the States than here in the UK -especially since my FLR has been postponed due to a few missing documents that were needed-. Anyhow, I've just started to research the process of moving back to the States with Aquila, my UK wifey. So I've got a few question since this stuff is ever so confusing...

Situation:

I, the US Citizen, don't have my FLR or ILR. I'm living in the UK on my fiance visa that I got in LA back in October.

Aquila, the UK Citizen, has her UK passport.

Question:

1. Can Aquila and I travel to the US...Aquila as a visitor...and apply for the I-130 and then the K-3 visas? Or would we have to remain in the UK and apply from here?

Any help or links to threads where this has already been discussed would be greatly appreciated. Thanks bunches!

As far as I know...your wife will need to obtain her visa here before moving back. Which means, applying through USCIS for a K-3 visa and then adjusting her status once in the states, or (what I am in the process of doing) submit the I-130 to the service center having jurisdiction over your last known US address (since you are considered a US resident still by the govt.) and if approved, work from here to obtain the CR-1 visa and have her interview in London etc...

Or, if you are unable to work here and need to start up soon...you may have to move back to the US and petition for her from there.

There is a lot of info at www.visajourney.com
or
www.diveintoamerica.com

Good luck to you both! :)
