student -> fiancee visa?
« on: December 06, 2003, 03:47:51 AM »
Please forgive me, I'm sure this has been asked before!

I know I can't go from a tourist visa to a marriage visa.  Can I, however, go from a student visa to a marriage visa?  Or a fiance(e) visa?  Anyone know?

Thanks.  Forgive me for asking an old question, I couoldn't find it on overthepond.info or the home office site - I DID look!

My passport was originally stamped as a student..when we got married we went and applied for flr - further leave to remain and it was then stamped differently...hope that helps

If you are in the UK on a visa that is longer than 6 months - i.e. NOT a tourist 'visa' - then you CAN transfer to a marriage visa without leaving the UK.  You cannot apply for a Fiancee Visa within the UK - it is only an entry-type visa, whereas the Spouse Visa (applied for in the US) and the FLR(M) (applied for in the UK) are pretty much the same thing.

Simple answer - if your student visa is for a period longer than 6 months and you get married whilst in the UK, you do not have to return to the US to get the Spouse Visa.  You can simply apply to the Home Office with the appropriate paperwork and fee.
