If your fiancee is a UK national and you have a fiance visa you do not need a Certificate of Approval - you would only need this if you were in the UK on another category, ie work permit, student visa etc.  If you tell the registrar you have a fiance visa you will be fine.

V, could this also have something to do with giving notice?

Yes we scheduled an appt to give notice and the women told my fiancee that we might need a certificate of approval to marry, but she "thought" my fiancee visa would be enough.  Btw he is a UK national, and I have my fiancee visa from the British Consulate in NY.

Excellent.  No COA needed then.

Silly people who don't know their own rules.  You only need the Certificate of Approval from the Home Secretary if you are in the country under some sort of other type of visa and you have sucessfully appealed to get married anyways.

I don't know, but is the Bury registry one of the designated registries that can handle immigration controlled marriages?

Yes Bury is one of those that can handle immigration controlled marriages, the registry at Melton sent us there and the woman led on to my fiancee that they could handle it.

I am not in the country (I am in the US)  as of right now, so what you are saying is my fiancee visa is all I need???

Giving notice is almost as bad as asking for advice to get my visa for an "immigration specialist" in a local congressmans office.  I was told "Oh you don't need a visa just go get married on your passport then apply for citizenship"  She was an idiot.... but I digress.  Thanks for the help everyone.

Well, you need to be resident in the UK 7 days prior to giving notice as well (except Scotland), you also need to give evidence of name, age and nationality (your passport) and proof of address.  You will also have to pay £30.00 per person to give notice and £40.00 a couple to register.

But as far as proof that you are in the country legally to marry, you just need the fiancee visa in your passport.

Yeah I knew about the 7 day requirement, I will have that covered by the time our appt rolls around.  Just was wondering why I needed a certificate on top of all the other garbage I had to get.  Thanks for your help.
