IRL Issues From Military Service

I’ve just sent off an enquiry to the IND about this, but in the meantime I’m hoping someone on here can provide some input for me.

My husband (British) is a member of the Territorial Army and has just received word that he will be mobilized and sent to Basra in November.  Needless to say, we're both in shock.  Somehow it feels petty to be worrying about visa issues at the moment, but at the same time I do need to know in case his appeal for exemption fails. 

Seeing as how this Novemeber will be at about the halfway point of my two-year spousal visa, I’m fairly certain that when my visa expires it will mean that I won’t be able to qualify for ILR as we won’t have met the two year cohabitation requirement.  As far as anyone knows, is this the case?

Wow, this must be a terrible shock for you both.  I didn't even realise that the TA were being sent in, and I hope everything goes okay.

With regard to your visa, don't worry.  You will still be resident here and your husband will certainly not be deemed to have changed his place of residency, so I am sure it will all be okay.  If he had been sent abroad for work then you would still qualify, so I don't see why this would be any different.

Do you know how long he is likely to be away for?

We’re in absolute shock.  He’s appealing based on his employment situation and the fact that he’s due to start college in September, but there are no guarantees.  He would be sent over for a ten month tour, which raises even more questions about whether I would even want to stay here that long by myself or try to start the visa process over when he got back if possible (needless to say at this point I’m trying not to think if he got back). 

People in his unit have been in Iraq as volunteers since the beginning of the war, some of them going for multiple tours.  The situation over there has become so bad, however, that they are now starting to ‘draft’ soldiers as hardly anyone will volunteer to go.  From what I hear, the conflict is the last in a long line of issues that has decimated the ranks of the British military itself to the point that it can’t even be considered an army anymore, but is now so small it’s technically a defense force.

Hi There,

My husband is in the military (Royal Navy) and he'd been away  more often then being home including a six month tour to the Falklands during the two year waiting period between my FLR & ILR.  It caused no problems in obtaining my visa.   When we went to the interview we brought along with us a letter from his CO as well as letters & eblueys we sent to eachother.  They only took the letter.

If/When he leaves you should probably get a call  or visit from the welfare people or something similar (at least that's how the Navy works) you might want to bring up your concerns about the visa with them and they may be able to do something.

Hang in there, it's not as bad as you might think being on your own like that, if anything it makes you adjust fully here (at least it did me). I have a friend at work who is in the TA and he's also being sent.  We've had friends sent to Iraq including Navy guys and if it's any consolation (probably not much) the comms are pretty good.  Mobiles work a lot of the time and they had a fair amount of access to MSN messenger. 

Sorry I can't offer much more advice then that.
