fiancee visa
« on: May 26, 2006, 07:11:43 PM »
 :)
could you good people be of help i am trying to get the girlfriend (Kim) and baby over from the USA we were planning on her coming over for a month so everybody could meet the baby (Sammy) however we also had her dog doing the quarantine bit which will be complete in 2 weeks, i have suggested she will have trouble at immigration if she turns up with baby and dog, does not look like a short stay in my books could be asking for trouble.... how long is the present time scale to get a fiancee visa once we get all the paperwork complete and submitted, if i am reading things right she would have to go to chicago as she lives in Ohio. we have decided to get married anyhow either over there or here don't know which is easiest and i will probably end up wanting to live in the USA.... many question still but lets start that for now

If you're going to get married anyway, it'll be easier all around if you get married first and go for a spouse visa.  Otherwise, you'll have to get a visa for the baby-if you're married, you won't.  I wouldn't arrive with dog, baby, and everything without a visa unless you have proof of a job, house, etc to go back to.

Yeah, showing up with a baby and a dog isn't a good idea at all.  As Mindy suggested, getting married and applying for a spousal visa is probably the simplest route.  If you get married in the US, you won't need a fiance visa and you guys can go to the Chicago consulate and, provided you have the correct documentation, leave with the visa the same day.

You'll need a visa for the baby as well.

marrying your gf in the US when you intend to go back to the UK and live is quite simple- you just go in as a tourist, get married, then get her a spousal visa and you guys hop a plane back to the UK.  that's it! :)

I have a question regarding the fiance visa.  I talked to someone in immigrations and they told me that if my fiance came over on a visitors visa and we got married that it would take longer to get the paperwork through changing his status.  basically she said if i applied for the fiance visa first everything would go smoother.  But to me the fiance visa almost seems like a waste of money if i can just get married to him when hes over for a visit....would love some advice..thanks!!!

are you talking about marrying in the US and then adjusting status to stay in the US, or the UK? (Getting married as a visitor isn't possible in the UK, btw.)

If you're talking about the US, in this case you would need a K-1 fiance visa.  It's illegal to come to the US as a visitor with the intent to immigrate (in this case marrying and then adjusting status.)  Getting married in the US on a tourist visa waiver only works for those who are not planning to settle in the US afterwards.

it's true...as long as he intends to return to the UK to live. Many people on this board have done just this, then got the American half of the couple a UK spousal visa.

Andrea you are wise & wonderful...  In your opinion is it worth him coming here to get married & then my applying for a spousal visa for the UK, rather than applying for a fiance visa & getting married there?   (Thank you!!)

Aww thanks  :)  It's really up to you guys...you can weigh the cost of a plane ticket to the US, the actual cost of getting married (license, etc), and the cost of a spousal visa ($494) versus the cost of the fiancee visa ($494), registry costs and other "getting married" expenses in the UK, plus the cost of the 2-year FLR after marriage (£335 by post, £500 in person.)

The FLR is basically a Spousal Visa, which you will have to get regardless of where you get married, so you might as well get married in the States and only pay the $494 once, or $506 if you mail the app in instead of going in person.
We were married on the 27th of May, sent in our FLR Visa app to Chicago on Tuesday the 30th (overnight FedEx), they received it the next morning and I received an email from the consulate on Friday saying it had been approved and was on it's way back to me.  Had it in my hot little hands Monday afternoon :)  If we hadn't gotten married on a Holiday weekend I would have had it by Thursday :D
As long as your paperwork is in order it shouldn't be a problem.... Good Luck :)
Only Time will tell.. it's just too bad she's a closed mouth B**!!!
