Property Repossession

Ok, I'm hoping that one or more of you may be able to give me some advice on what to do.  Today in the mail, I received a letter from a law firm (Hamlins Solicitors) indicating that they were acting on behalf of Mortgage Express to recover possession of the property that I currently rent through Foxtons Property Management.   A hearing has been set by the courts for 24th July.   

I immediately contacted Foxtons who are now contacting the private owner of the property.  However, in that Foxtons works for the private owner and not me, thinking I need to get my own advice.  As such wondering: if the mortgage company does indeed gain repossession, can they kick me out?  Or will they honor the lease I have in place which doesn't expire until May 2007?  Should I start looking for someplace to live?  Or should I wait and go to the court hearing to see what happens?  I'm totally confused and somewhat scared as to what I should be doing.  It wasn't easy finding a rental place that would fit my furniture and allow me to keep my cat so really concerned about possibly having to move on such short notice.

HOw disconcerting, to say the least! You might want to look at your contract. I believe the magic phrase is something like Assured Shorthold Tenancy. I *think* if you have that, that your tenancy has to be honoured by whoever ends up owning the property.

For advice, I would think the citizens advice bureau would be a good place to start.

Good news everyone!  I don't have to move.  The landord paid the mortgage payments that were in the rears and has promised not to let this situation happen again.  Either way, it was quite scary as in reading through the rental agreement as well as talking with the mortgage company and others, came to realize that a tenant such as myself really doesn't have much rights in these sorts of situation.  All of this makes me want to get into my own property sooner rather than later.  However, all in due time as with house prices what they are, I need to do a bit more saving.

You may have had rights as a sitting tenant anyway.  You might want to look into this in case it happens again!
