Visa Application?

Hello All! I'm finally able to begin my Visa application. I'm going for the Fiance visa. My Sweetheart said yes on August 5th at the Etrop Grange Hotel by the Manchester Airport the night before I returned to the States. I have most of what I need RE: bank statements to date, proof of meeting her (New York, York, and Scotland!), Passport, Passport photo, my letter of intention, my Divorce papers, and letters of reference from my Supervisors at work.  I'm going over again on the 17th of August to help her pack and move into the house she just mortgaged.  She's not quite divorced yet, but is well under way. The sale of the house she and her soon ex once occupied will be done on August 30th.  I know I need her Passport, her letter of intention and a date and place of our wedding. Am I missing anything? Is there more I could do? Do I have to fill out AND include a hard copy of the Visa application as well as the online application when I Fed Ex it all to the New York City Office? I'm ready to move forward to start  my life in England with the love of my life and her two children as soon as I return to the States on September 10th. Looking forward to any help from this wonderful site that has been so helpful thus far. Thanks. Fred and Caryn

The biggest thing is that her divorce needs to be final.  You are unlikely to get a fiancee visa until you do so.  Also, because she has minor children you will need permission of the Father to take the children abroad.  Being in a middle of the divorce, are you sure the father is going to be willing to allow this to happen?

Also, you will need to apply for entry clearance for each of the kids as well, as a dependent of someone entering the UK as finacee.  The kids passports will need to go, plus the proof you can take them out of the country in the same packet to the NY Consulate, but you will owe 3 visa applications of money.

Proof of accommodation in the UK, your work contract and/or payslips also seem to be missing off the list, as well as her letter.  If you are making enough and she doesn't intend to work, then you don't have to worry, but if she intends to work or you suspect you will need financial support from her to be stable, then she will need to include her CV and bank statements.

I think Fred is the American citizen here, and the one seeking the fiance visa.... :) 

Fred, kitsonk is right in that your fiancee's divorce is going to need to be final before y'all can make an application for your visa.  Since the UK citizen is the sponsor in this case, you'll also need a letter from her stating her intention to marry you and support you until y'all tie the knot, her payslips and bank statements, and letters from her employer and a copy of her mortgage to prove that she'll have a place for y'all to live and money to keep y'all fed and clothed. :)  It'll help if you've got savings of your own to contribute, but the burden of proof is going to be placed on her as the sponsor of your visa.

There are likely other things you'll need to include that I'm forgetting at the moment (it's late, and I'm sleepy!), but you should find a good list of those documents elsewhere on these forums, if you do a search.  The most important thing at this point are those divorce papers.... :)  Good luck!

You can still apply if you can show that the divorce is "well under way" and will be final within the 6 months of the fiance visa. I applied for and got my fiance visa before my husband's divorce was final. I submitted a letter from the court showing the decree nisi date. If she has something like that or can get her solicitor to write a letter saying that the divorce will be final before the fiance visa expires, you'll be fine to apply.

Tanis is correct, they just have to be satisfied it will be finalised in time for you to marry within the 6 months granted.

OOoooops, you are right, I got it all backwards...

So ignore what I said about the kids...

You will need her passport, the mortgage papers on the new house, and she will have to provide a financial and work related information.  It is somewhat "optional" for the applicaint, but essentially mandetory that the sponser prove their financial situation.

Sorry about the confusion, I am a newbie! I'm the US citizen, Caryn is my English fiance. She lives in North Yorkshire with her two daughters. I'm divorced now and have the enough from the sale of the house here to support myself for a year there, although we want to be married soon after I arrive. We initially intended for her to come here and start life here but her ex refuses to let the children leave the country although he doesn't REALLY enjoy them. We were going to fight him on it but decided the courts take too long and we can't stand to be apart for much longer.

She recently went back to work after staying home to raise the youngest, and has been there 3 months and receives Public assistance as well. We'll be able to live without that as soon as I get a job and have my income to decrease or eliminate the Assistance   I'm leaving a New York State job to be there with her and start anew. I'm praying for a Visa and to be there with her. I'm going over again on August 17th to help her move and collect some of the things I need from her like the Passport, her letter of intention, proof of accommodation, her bank statements, her letter from her Solicitor about the state of here divorce and settle on a date of Marriage. I will be back here on Sept 10th, recover from the travelling and moving her into our new house and apply for the Visa.

All this info is neatly organised and indexed in a nice accordian folder waiting to go, with pictures and all. DO I need to include a hard copy of the application in here or is the online sufficient? I'm the type that needs everything to be perfect and orderly and I need to be with Caryn more than anything. Am I on the right path? Thanks for the support.

I have read many threads of people who got in with less than I have and try not to compare   my situaion with others. It's heartwarming to see others get there and start their lives, and wish mine goes as well. I don't know what I would do without her and want to be Mr. and Mrs. by the end of 2006. She can't do it alone and needs me there as much as I need to be there.

When you fill out the application online, they will tell you to print it and include it in your supporting documents. Good luck.
