Hi Vik, I'm in the same boat. Pretty sure I'm going to get my second refusal. At this point I want my husband and older kid to come back to the US for the summer, and I think I'll reapply in September. It will give us a reprieve from the headache and heartache. Plus we can use the extra time to gather everything up.

Although I'm thinking if processing times settle down late fall, I will go back in September under the visa waiver and spend time there and then come back and reapply.

I am staying with my parents in the US so it's not that difficult for me.

I'm so sorry you are living with this uncertainty.
But just be careful that your plan for your husband to visit the US for the summer won't affect his ability to meet the financial requirements. I know he was using employment income rather than savings, you would need to do the calculations.

Also, the visa waiver program is a US specific thing, the UK equivalent would be to get your visitor visa on entry to the UK but *if you arrive with 2 prior refusals, (and really hope you don't get your second) then there is very high chance that you would be turned back at the border, as it may appear that having failed to obtain a spouse visa that you will now try to get into the UK at any cost and just stay. I know you would not be doing that but they will have seen that before.
So you would be strongly advised to apply for a visit visa in advance in that case.

thanks for the information, does that mean he needs a minimum balance in his account?

No, he needs to have made the equivalent of an annual income of 18,600 in the 6 months immediately preceding the application, just like he did before.
I was concerned that if he was to take a long break from work that he would not be able to meet that requirement.

This is a guide to what is needed to visit the UK.
https://www.gov.uk/check-uk-visa

If you check "US" and "Tourism, including visiting friends or family" it ends up with this-

You won’t need a visa to come to the UK

However, you should bring the same documents you’d need to apply for a visa, to show to officers at the UK border.

You may want to apply for a visa if you have a criminal record or you’ve previously been refused entry into the UK.

That "you should bring the same documents you’d need to apply for a visa, to show to officers at the UK border" links to this guide.

Great!  :) There would be no problem with the requirement in that case!  :)
