How do I "break residency" with my home state?
« on: February 27, 2004, 10:52:11 AM »
I've been in the UK since October 2003.  I've just filed my taxes (fed--MFS, state--MFS).  I'm wondering what I should do next year.

I know I'll have to file my federal taxes forever, but what about state taxes?  I'm from North Carolina.  Is there an official way to break residency from the state, or do I just stop filing NC taxes?

Thanks! :D

Generally with the states (if they are not domicile states - North Carolina is not) you can break residency in the year that you leave.

So what happens is that in 2003 you will need to file a part-year NC return (as you were resident for part of the year). Reportingyou income and deductions only for the resident part of the year. From 2004 onwards you will not have to file a NC return if you do not have any NC source income (rental, partnership, etc...).

Hope this answers your question.

You do not determine this. You just have to read the instruction to find out whether a particular State is a domicile State or not. For instance MA is a domicile State.

Do you mean the instructions on a State Tax return? If not, where? I don't mean to be thick but I don't understand where to look to find this information...

thanks

Here is the State links. If you click on any of the states, it will give you all the forms, and instructions for each State that you have chosen.

Hope this helps you...
