Beating Speed Camera Tickets

I got busted.  However, there is a chance my wife was driving, we're not sure.

I'm going to ask for the photo so we can find out who was driving but tell them we are willing to pay a fine with no points if we can't determine who was behind the wheel (hopefully that works, we don't want any points!).

Anyone know anything about or have any experience with dealing with these tickets?

Always ask for a photo. You're doing the right thing. I'm not sure if there's a way to avoid getting points, though, even if the photo can't determine who was driving. Someone else on the board might have more insight into this.

Be prepared to be taken to court if you cannot identify the driver at the time as the registered keeper is required by law to do so (in accordance with Sec172 of the Road Traffic Act 1988, the punishment is usually about the same as the original speeding offence)...there is a defence however to this and it is;

unless he shows to the satisfaction of the court that he did not know and could not with reasonable diligence have ascertained who the driver of the vehicle or, as the case may be, the rider of the cycle was.

They may only give you the photo's if you contest the ticket and decide you wish a court hearing (as it is evidence they have to disclose it to you) instead of it to be dealt with via the Fixed Penalty System, it is their choice as some partnerships will give you the photo before and some won't. It is very unlikely they will accept a deal of just the fine and no points, more likely they will just take you to court for failing to identify the driver. i fought a speeding ticket on these grounds.  basically, my partner & i were caught speeding on a routine to/from food store.  b/c car is owned by leasing company, it took 5 weeks or so for me to become aware of the offence.

5 weeks ago... routine trip (taken weekly)... neither my partner nor I could say with any level of certanity who was driving.  it was probaly 60% me, 40% him.

well... after 14 months... multiple letters... one court appearance.... i won.  and i got them to award me costs.

if i knew with certainity who was driving, i would have admitted my mistake & paid the fine & gotten the points.  however, i got really stubborn when i had someone from one of the offices (police or court- can't remember)- say that i should just lie becuase it woudl make my & their life easier.  being asked to perjure myself just wasn't something i was willing to do.

On a slightly different note, I have recieved three fixed penalties from speed cameras over the years, none of which I have any reason to doubt the accuracy of. Despite this, on each occassion I wrote to the issuers explaining that my car had a telematic tracking device fitted and that the data this had recorded said I was not speeding at the point they claimed and so I would like to go to court over the alleged offence. I have no such device in my car, though I have had one previously when I used to work for a telematics firm. In all three cases they immediately dropped the prosecution.  ;)

I'm glad it had a happy outcome for you .... but what would you have done if they had said, "Yes, let's go to court"?    ???

I'd have just gone to court and pleaded guilty. The courts are so over stretched that the camera partnerships have been told to avoid bringing speed camera offences to court at all costs providing the speed limit was not exceeded by more than 30 mph or yhe identity of the driver is in dispute, so the odds were heavily on my side as all three alleged offences were only a few mph over the limit.

Has anyone had someone visiting them in the UK on a US driver's license and got speeding/traffic violations while driving your registered, insured car?  OR has anyone tried to pass their UK offences off as this was the case to avoid accumilating penalty points?  what would this process be, ie, courts, petitions, etc?

If they catch you, heavy fines. I have read that they have even jailed people for trying to pass off their ticket on someone else. Are you driving without a UK licence? If that is the case, start the process of getting one ASAP.
