Topic: Marriage in Chicago -procedures to follow with Dh coming from London  (Read 1403 times)

Hello there,
    I was wondering if anyone would be able to answer a few questions.  My fiance is a Brit National and will be coming over to the US to marry me in Chicago .  I too BTW am from Chicago, well you see my Fiancee Visa will expire on the 8th March and he is still in the process of a BAD divorce, anyway  if his ex agrees to the financial settlement this week he can then apply for the Decree Absolute on the (9th march  go figure  huh).  Short of my visa by one day  grrrrrrrrrrrr.  I was told i wouldn't be allowed the visa extension unless I was hospitalized or some other very compassionate circumstance. grrrrr .   So I must return to the States and marry there. 
     When he comes the the US and speaks to the IO should he state that he is there marry me.  He will have all the necessary documents with him.  i.e. Divorce Decree, sponsor letter stating his intension of marriage to me, lodging, employment stubs  all that stuff thats needed for the Brit Consulate in Chicago for me to get the spousal visa afterwards.  I just want to know what he should state to the IO. I do not want him detained at IO for any reason, so we want to be upfront on all aspects, so should he tell the IO that he is there to marry a US citizen?  Also I understand it is REAL easy to marry in Chicago, get the license one day and the very next we can go back to Cook County or DuPage County Courthouse and marry, am I correct?  and its also roughly cheap, any figures that you may have will be GREATLY appreciated. . Providing we get the marriage certificate the next day and then apply for the spousal visa?  Has anyone else gone thru Chicago to get married.   I understand the cost of the Spousal Visa has gone up now to $520.00 so we still are limited on the funds, since I'm not allowed to work here in UK for the past six months.  Anyway.  I sure hope someone can help me out.

Honesty is usually the best policy. But you should explain that you will be living with him in the UK and provide documentation to back that up...such as lease agreements, letters from employers and/or bank statements. Then you should be fine.

I agree that honesty is the best policy, but he should just answer the questions that are asked of him. My now-husband came over to NYC last October for our wedding (third time that year he had entered the US). They asked him if he was there for business or visiting, and how long he was staying. He answered both of these questions, and they let him through. He didn't volunteer anything extra, because it wasn't necessary. He didn't try to hide anything, he just answered what was asked of him.

However, if they had asked him more specific questions about his trip he would have been completely honest. He had a lot of proof to back up the fact that he wasn't trying to settle in the US (including all the paperwork for our marriage visa--and an email showing that we had an appointment at the consulate) so no reason not to be upfront.

Thanks for the info ladies. I too agree on the honesty aspect of this all..  I didn't know if the Homeland Security was the same as it is for the IO here in the UK.   As far as him stating he was there to marry see a US gal.  My second trip to the UK i made the error of saying i was there to see my boyfriend and they denied me access. grrrrrrrrrrrrrrrrrrrr so I just wanted to make sure he had no problems.   But my third try to come visit  i was allowed in on my fiancee visa.    :D

I got married in Lake County (my husband is from Scotland and I'm from Chicago) and it was really easy and cheap (I can't remember exactly how much, but you pay for the marriage license and then for copies of the certificate - I got three copies of the certificate).  There should be a website for Cook and DuPage County Clerks which will tell you how much.
As far as him being honest when he comes here, I wouldn't volunteer any extra information.  Like Kate said, answer what is asked and he should be fine.
Especially because your bf could come on a visitor visa, get married and apply for a change of visa status (unless the rules have changed since my friend and her bf did it in 2003).
