Are we doing anything really wrong?
« on: March 31, 2004, 11:01:32 PM »
Since he's not planning on staying here, just visiting for a few weeks and getting married and returning back to his country (where i will join him when i get the visa from the NYC consulate), we're not doing anything wrong....correct?

I get so nervous that he'll come over and then be denied or something.  We go back and forth every month (only weekends at a time, no extended stays) and i don't want a 2 week visit to raise a red flag.  He knows to travel with all documentation from employer, accounts and lease information if he was questioned and that indeed he would be returning to live there......

just thoughts on my mind.   :P

You're not doing anything wrong.  This is the way my husband and I did it and we had no problems.

i didn't think so elle, but i had to check.  it's just so stressful dropping an obscene amount of $$ and then thinking 'oh my god, what if he isn't supposed to do this'.

That's what we did as well.  DH went to the US for about two weeks (for wedding and honeymoon).  We went to NYC for my spousal visa, and were on the plane to the UK a few days later.

Good Luck!

(my experience w/ the NYC consulate is on my website, if you're interested)

Not to be a downer, but I worry. I've been told it is wrong to get married here on a visitor visa. Can they deny a spousal visa or anything else due to this?

As long as he's not planning on settling in the US, he can go into the country and get married.  Then they apply for HER Spouse Visa to settle in the UK.

According to what i was told (from the NYC consulate and a family friend who is an attorney), it's all about INTENT.   If you come to the US and have the INTENTION of marrying AND staying in the country, then yes, you must apply for a fiancee' visa.  If you are simply visiting the country to get married and have no intention of staying on permanently, then it's perfectly legal to get married on a visitor's visa.

Exactly right.

I mean, two UK citizens could go to the US and get married in Vegas if they wished.  They wouldn't have to obtain Fiancee Visas or any other sort of visa if they were just coming over to get married and then return to the UK.

Feeling even better!  no intent to settle back here for a few years yet.  :)

I love this board.
