Basic Question, but I'm floundering
« on: June 06, 2008, 01:01:19 PM »
I worked in the US in 2007. I was married to a UK citizen in July 07 but didn't move until December. My husband does not have a SSN nor has he ever lived or worked in the US.

1. Do I file jointly or seperately?

I know that I don't need to file for my wages in the UK as I didn't make enough money in 2007.

2. Must I claim my husband's UK wages as foreign earned income?

In the US I didn't own any property, don't have any dependants, and earned about 10,000 USD as I was also a student.

3. Should I simply be filling out a 1040 EZ as well as sending a note detailing my foreign address etc. in order to be eligible for the automatic extension?

Thanks for any help, this is doing my head in!

Married filing separately, unless your husband has a ITIN or SS #.

Did you earn any money in the UK in 2007 if you moved over in December of 07?

Even if you didn't earn more than the allowance for foreign income you still need to report it on 2225  (or another form which I am not sure of the number.)

2.  If you aren't filing jointly then you don't report your husband's earnings.

3.  That I am not sure about.  I suppose that depends if you actually earned any income in 2007 in the UK, if you did you need to file other forms which would have your foreign income listed.

I earned 2 weeks worth of income in 2007 as I started working for a company on Dec. 14th which amounted to about 120 GBP. I read on the London-UK IRS website that anything under 3,400 USD didn't need to be reported if filing separately?

http://london.usembassy.org.uk/irs/irswho.htm

I think this is where my main source of confusion lies.

Thank you so much for the help with the other questions though, really cleared up a few points!

Dont mean to hijack.. but just mailing off my taxes this weekend (oops)

Do i need to include my P60... P45.... any pay stubs?  Or do I just mail off my 1040 and 2555?  Do they need proof of what my income was in the UK?

Nope. I brought my paystubs with me when I dropped off my taxes at the embassy, and the woman said not to include them. I would keep them with copies of your taxes, however, in the event that you are audited (unlikely, but possible).

Thanks Kate.  :)

Ooops!  I mailed mine.  Oh well, I have a copy of it.
