Immigration control?

my husband and I are trying to register to go on the list for council housing, i am sure we wont get anything but there are several schemes in this area for first time buyers that we will want to take advatage of in around a year and you have to be on the list to do that.
 I am british, hes american and we just moved back june 2nd, hes on a spouse visa for 2 years. The form says that you arent allowed to be subject to immigration control under the asylum and immigration act 1996.
 Is he? i have looked up the act and its so wordy i really dont understand it.

British citzens are not subject to immigration control.

I don't think he would be allowed to get the benefit of council housing, if he's an American citizen.  Maybe others can correct me if I'm wrong, but I thought that you weren't eligible for stuff like that (and jobseeker's allowance, etc.) unless you have indefinite leave to remain (and not just a spouse visa).

Since he's American and is here on a spouse visa, he is subject to immigration control.  It means you have to have permission to be here, essentially.

You can still put your name down for council housing but it would have to be in your name.  We were on the Council list with no issue and I am still not allowed access to public funds.  It just means that the Council will look to you as the applicant and allow your husband to live there.  Technically he would not be accessing benefits.  Plus the schemes you are referring to are not a benefit per se but a scheme to help people on the housing ladder.  We went on the Council list for that very reason.

Council housing is a benefit.  If you are eligible as an individual then you may be elgigible as a couple, but if the reason you are successful is because your husband is there then this would be him claiming state benefit.
