CAN SHE COME
« on: August 25, 2008, 03:57:17 AM »
I may have to go back to the uk, I got into a small fight and I broke someones nose.

I am told that even though I have no record I will go to Jail, my wife wants me to leave now, with her (she is from the US).

But she is listed on the bail bond...

If I leave what will happen... how can we travel together and stay in the UK?

Thank you guys....

I know I sound like a thug, but really, I am a normal guy who made a big mistake.

I don't know that you are going to get advice here on how to do something illegal, like fleeing the jurisdiction when you are facing criminal charges.  When you are done serving your time, your wife can apply for spousal visa and join you in the UK.

Leaving now with an active warrant or to avoid serving a sentence is a huge mistake.
Love your life, poor as it is. You may perhaps have some pleasant, thrilling, glorious hours, even in a poorhouse. The setting sun is reflected from the windows of the almshouse as brightly as from the rich man’s abode; the snow melts before its doors as early in the spring. Cultivate property like a garden herb, like sage. Do not trouble yourself much to get new things, whether clothes or friends. Turn the old; return to them. Things do not change; we change. Sell your clothes and keep your thoughts…

Definitely doesn't sound like the best plan for either of you, especially if you want to return to the US at any stage.  Kristi is right, you should wait until after your court case/sentence is over.

You are right, we discussed it this morning.

I have to deal with what I did and then try to put my life back together.

If it is a minor assault and you have no prior convictions, I don't know how anyone can say with certainty that you will go to jail.

Good luck.

Thanks for the support.

I spoke with a number of attorneys this morning, who all feel that this will not result in a prison sentence, but its hard to believe them because they are selling their (expensive) services?

The issue is that it is being seen as an unprovoked attack...

I turned from the bar and brushed against a girl, she had a full glass and some of it spilt.
Her boyfriend who was about 6 inches taller than me, a very big man, pushed me.We had an argument and I put my hand out to shake his, but he crushed my hand so I hit him with my head?

Not the door men say that he was trying to be nice and I attacked him?

I feel like a complete idiot, whatever the excuses, what I did was wrong,.

I have my interview with the INS in a few weeks, so there is no chance I will be allowed to stay.

Even if I only get probation I will have to leave afterwards, I will be deported, or so I am told.

We spent $20,000 on the bail and another fortune will go on legal representation, plus I will have to pay damages to the other guy.

So here is the question....

How can my wife come with me to the U.K. ?

We met in New Orleans, we were both doing volunteer work rebuilding houses, and since then have never spent a night apart. The night I was in jail was the first time, and I do not want it to happen again.

If we apply for a visa they will want proof that I can "support" her, which I cannot prove?

Is she best to come as a tourist, can we then apply to change her status?

Many Many Thanks for your support & advice.

Brian

She can't go as a tourist and change status.  The only way is to apply as a spouse from the US.
