Criminal record, should I just send in the printout?
« on: October 09, 2008, 10:54:06 AM »
Hell everyone, I was wondering if anyone can help with this as it seems like the one sticky subject in what is hopefully an otherwise quite adequate application.
My American partner is planning to apply for a spousal visa but his criminal record is as follows.......

INFRACTION - date;17 10 1998- expired inspection sticker - dismissed by DA
TRAFFIC -  date; 17 10 1998 - failure to comply with license retrictions (didn't have glasses on)
INFRACTION - date; 11 07 1999 - speeding -DROPPED
TRAFFIC - date;11 07 1999 - failure to notify of address change - dismissed by DA
INFRACTION - date; 07 09 2000 - improper equiptment (speedo) - not on license
INFRACTION - date; 07 09 2000 - license not in possesion - dismissed by DA
INFRACTION - date 13 11 2000 - improper equiptment (speedo) - CHARGED  TO PAY COURT COSTS
TRAFFIC - date 13 11 2000- license not in possesion - dismissed by  DA
INFRACTION - date 08 02 2002 - improper equiptment (speedo) - CHARGED TO PAY COURT CASE
FELONY - date 01 03 2002 - possession with intent to sell and deliver marijuana - GUILTY -18 MONTHES SUPERVISED PROBATION - $840.00 fine
INFRACTION - date 03 01 2004 - improper equiptment (speedo) - CHARGED TO PAY COURT COSTS

I'm quite worried about how this list will appear and despite finding a link to something supposed to explain what is considered spent, what the uk equivelant sentance for the felony would be etc, it honestly confused the hell out of me and I'll just admit the jargon left me more confused than ever!
If anyone could tell me if they have ideas I would be very grateful.
Also considering this list should we just send in a copy of his criminal record and let the ECO decide for himself what is relevant as we are on a very tight time limit and would rather he have the evidence in hand instead of having to delay things by hunting about for stuff that we can provide him with and only list the felony on the actual online application.
Thank you all very much

Send the sheet in, and don't worry.  These are minor offenses which will almost certainly not result in a refusal.

I'm sure Vicky is right... she knows all about this stuff!   :D

Just wanted to say that I had a few such minor offences, but when I ran my criminal record online to see what was there, nothing came up since they were all 7 years old or more (but I had never been convicted of anything, they were just arrests, one where I was found not guilty and one (a misdemeanor possession of marijuana offence as well) that I did six months probation for under deferred adjudication, so it would only show up as an arrest, rather than a conviction.  But that was in 2000, and it seemed to have dropped from my records by now.
I only wrote down a speeding ticket I had received a few months before applying.  Not sure if that was the correct thing to do, though.
It's probably safest just to mail in the sheet, since as Vicky says, none of those would cause refusal anyway.
Good luck!!
