 Vicky-
My husband has the appt tomorrow, and my father in law is paying for it. Would my husband be able to contact you or would I need to do it?

Hi Ange,

I really do hope everything works out, and I hate the fact that you are going through this, it's never right and makes no sense.  Cases don't always fit into tiny rule boxes--everyones is different.

I didn't want to post hijack so started a post topic=48877.0 .

I wish you all the best and a visa :) in your hand, take care, Chantel

Even though you found it for others Section 9 - Part 320(11) states:

Quote
where the applicant has previously contrived in a significant way to frustrate the intentions of these Rules. Guidance will be published giving examples of circumstances in which an applicant who has previously overstayed, breached a condition attached to his leave, been an Illegal Entrant or used Deception in an application for entry clearance, leave to enter or remain (whether successful or not) is likely to be considered as having contrived in a significant way to frustrate the intentions of these Rules.

As you can see, overbroad, so they may claim, but hopefully won't that you intentionally flew to the UK knowing you would be giving birth they and they would have a hard time removing you, though none of that is true.
WARNING My thoughts and comments are entirely my own.  Especially when it comes to immigration and tax advice, I am not a professional.  My advice is to seek out professional advice.  Your mileage may vary!

Well, no idea what my hubby is planning on doing with the lawyer right now. I told him to make sure the guy was OISC registered, and he told me the lawyer said he didn't have to be, since he was a lawyer and that was for people who aren't lawyers. When hubby asked him about dealing with Level 3 issues he laughed, then said he has been dealing with immigration for 11 years. "ask me anything about immigration and I can answer it" exact quote from hubby.
This is turned annoyed me a bit, and while trying to explain to him that I didn't think I was going to like this guy it caused a huge argument. I hung up on him. So...as I said, I am not sure what HE is planning on doing with the lawyer.

I'm sorry...I know how hard it is. We are in the UK now because I got so frustrated with DH that I screamed into the phone...I did not marry you to be a single mother again with no sex. I hung up and we didn't talk until the next day...when we were both calmer. \i hope it all works out as well for you.

The OISC and level 3 and what-not is for people who did not go to law school and have not qualified as lawyers.  They just picked it up as they went along.  That's why he doesn't need to be registered.  That's fine.

In the event you get refused on 320(11), however, he should understand that it's a charged topic and representations will be made about it in about 2 weeks.

If you want a second opinion on this, let me know.  I am a level 3 'just picked it up as I went along' person...who also (as with many of us) had huge amounts of training too (while working for the IAS).  I have 10 years experience.

Vicky's fine.  I make referrals to her all the time.

I think she's up to scratch on the 320(11) shenanagans also.

Why do I say that?  Because she alerted me to it in the first place.   :D

ok all...I was just annoyed at what my husband was telling me. Now that that has been explained I feel a bit better.
Vicky, talked to hubby about him saying he had emailed ur partner (which I had thought was the day before I emailed you). He had confused me. He had talked to him before we filed for my extension back in May. Sorry for the confusion. I would love to talk to you about helping with my case.

No one can promise you miracles...but if Vicky is involved not only will you get solid advice but a sound and steady mind when you are going crazy. I know...we had a horrid experience...almost as bad as this...and she got me through it in the end. She was the first person I called when my package from Croydon came.
