Do I need a Visa before I move to the UK?
« on: December 15, 2008, 03:05:41 AM »
I am a US citizen who is married to a British citizen.  We have been married 20 years and lived in the UK from 1988-1991.  At that time my passport was stamped saying I could stay and work indefinitly.  We moved to the US in 1991 and have lived here since.  We are thinking of moving back next summer.  Do I need to get a Visa?  Can I get citizenship or do I need to live in the UK for 3 years before I get that?

Thanks :)

Your indefinite leave to remain lapsed after 2 years being away.  The IO would turn you away if you returned and stated you were going to stay in the UK.

Best to apply for a new entry clearance visa via the [url:http://www.visa4uk.fco.gov.uk/]Visa4UK[/url] website.  They will give you a time limited visa which you can convert to an indefinite leave to remain once you have passed your Life in the UK Exam.  (Welcome to the new regime!)

As far as citizenship, you will need to be present and settled in the UK for 36 months prior to applying for Citizenship and have no time restriction on your stay (as of right now).
