no heat or gas / compensation?
« on: November 12, 2008, 08:16:03 AM »
Hi everyone. One of the gas pipes in our house cracked way open due to corrosion and we've been without gas for five days now! :(

The trouble is that it's not going to begin to be fixed for another six days, and it's driving me batty! I'm also worried about the mounting costs of having to run space heaters the entire time we're home. Is there any sort of tenant's rights that I can claim against for the cost of the heat and meals out we've had to take? Can I claim against my landlord's building insurance?

I just want to know what the options are (if there are any) before I contact my landlord about this.

Hopefully it won't go that far, but if you're without heat for more than 30 days, you can notify your landlord (in writing) that you will not pay rent until it is fixed - this is upholdable in court.  Unfortunately, 11 days would be seen as taking a reasonable amount of time to make the repairs.  If it looks like it's going to take longer, inform your landlord IN WRITING of your demands.

Also you agency / landlord can hire a gas heater whilst you are waiting for the repairs...That would be the decent thing for them to do..

Wouldn't touch gas space heaters with a barge pole.  Temptations to leave over night.  Is there enough purpose-provided ventilation?  No, no, would rather take the hit in the pocket with electric than not wake up at all.
