UK visa and DCF

I read in the DCF sticky that the USC's visa only needs to be valid the day before applying for DCF, but the post is a couple of years old, is this still the case? My husband and I have decided if we can, we are going to go for his green card rather than renew my visa in a country I am desperate to leave. However to file for DCF I need to be sure that is still how it works, because it will be valid when we send in the I-130, however it would not be throughout the entire process.

I'm really hoping it is still that it only needs to be valid the day before sending in the I-130, because otherwise I have to renew FLR and will be stuck here a further 2 years...I don't think I can handle 2 more years here.

As the USC only needs to be in the country for the actual filing of the I-130 but doesn't need to be here for the duration of the processing I don't see why you would have a problem.

That's just my take on it, you could also run it by the folks of several other forums - visajourney.com, diveintoamerica.com or britishexpats.com - for further verification if you wanted to.

Thanks :) I think we've found now that we can do it that way, and I will return to the US early to get things started over there if need be.

Of course now my husband has said we may be able to go for flr again for me and still get his visa straight away...seems a waste of money to me, but it does avoid us being apart for as long as my visa expiring mid-process might.  ::)
