Flying Aer Lingus with a spouse visa??
« on: February 25, 2009, 07:51:49 PM »
I was warned in a previous post that I shouldn't fly Aer Lingus coming into the UK with a spouse visa because my passport won't get stamped.

I did have a question.  We plan to fly into Glasgow the second week of July.  A few days later we will be going on vacation to Cyprus for one week.  Would my passport then be stamped when I come back from Cyprus which will be about 1 1/2 weeks later?  So would it be alright to fly Aer Lingus since I would get a stamp coming back from Cyprus?

It's not the airline that is the problem, it is entering through the Republic of Ireland.  If the Glasgow plane is direct, or if you don't go landside at a stop in Ireland, you are fine.  Otherwise, the Cyprus idea will work.

Yes, the flight does stop in Dublin.

And you change planes landside rather than airside?

I thought as long as you told the airlines that you need passport control, then everything is o.k. if you're changing over in Dublin?  Because I just might have to go through Dublin as well if I want a cheaper flight.

I believe Garry has said before that it's actually illegal for them to do passport control in the CTA. It's an issue they're trying to address, but at the moment it's not doable. Am I remembering correctly?
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012

It is illegal for the UK to have Immigration Controls on travel in the CTA.  ROI has changed it so they can and do.  The important thing is that right now, UK law does not permit it, no matter how much you yell and scream for it.

We have had specific instances of people transiting via Dublin to the UK and being told to leave the airport and that even though there were Immigration Officers in the airport.
